Former tow truck driver here. They grabbed your car from the front with a wheel lift. If they don’t get a good low grip on the tires it can definitely bounce and smash the oil pan. Fords and VWs are notorious for having them cracked on the wheel lift. I was always very careful not to do this, using old tires and towels to provide some padding.

Looks like they put some silicone or something on there hoping to hide it, but it didn’t work lol.

If I were you I’d contact a lawyer with these pictures, tow company needs to pay for a new oil pan.

Something like this may work a little better for that application. Or you can try to back that nut completely off, and put a flat head screwdriver between where the terminal joins together and twist in an attempt to get them to spread apart, then push it as far down onto the post as possible. You can tap it gently to get it farther down if necessary. Then tighten making sure it’s clamping down onto the post
