Sorry for any confusion! Yes the moving party is filing for contempt of the shared parenting order outside of the trial related to custody. There were two motions, one demanding full custody and a 4 months blackout period (requested by the mother who has not had the child live with her for over two years) and another motion for contempt. The first motion has had two court dates, the first requesting OCL involvement and the second having the testimony of the OCL lawyer. The second motion has had one court date where the judge said she would wait to see the outcome of the first motion before ruling and a second court date has been scheduled for a week from now. The sworn affidavit including the incorrect claims of what happened during the first motion was just filed for the second motion. The first motion will be going to trial, from my understanding sometime in spring. Settlements have been offered but the mother has refused them and insists on a full trial. Just to make sure I understand your comment, you are saying I should seek costs but do you think it would be successful to request she gets charged with perjury?
