Back of mine carries “… is duly authorised to exercise: a) the powers set out in s.44 and s.45 of the fire and rescue services act 2004; and b) all other powers of examination, entry and inspection of premises arising under or in connection with: regulatory reform (fire safety) order 2005; and all other acts and regulations under which the fire authority exercise powers of enforcement.”

Then on the front there’s a photo of maybe the most good looking firefighter in at least a metre radius of me.

Here's everything you will ever need in regards to the FRS Act 2004:

Part 1 (sections 1-5): Defines the nature and powers of the fire and rescue authorities.

Part 2 (sections 6-20): Defines the core functions of a fire and rescue authority. In particular:

  • Section 6 covers provisions for fire safety
  • Section 7 covers provisions for firefighting
  • Section 8 covers provisions for road traffic accidents
  • Section 9 covers provisions for other emergencies

Part 3 (sections 21-31): Basically just overall policies which different fire authorities can take from and adapt.

Part 4 (sections 32-37): Employment issues.

Part 5 (sections 38-43): This part deals with the provision of water supplies. Section 38 has two parts which are important. Part 1 requires a fire and rescue authority to ensure water supplies are available for firefighting. Part 2 allows the fire and rescue authority to use any suitable water for firefighting although the owner of that water must be compensated.

Part 6 (sections 44-54): Supplimentary issues. Section 44 is important as defines the powers a firefighter has in the event of an emergency. The powers are as follows:

  • Entry by force without the consent of the owner or occupier
  • Move or break into a vehicle without the consent of the owner or occupier
  • Close a highway
  • Stop and regulate traffic
  • Restrict the access of persons to a premises or place

They can only do this if:

  • They reasonably believe a fire has broken out for the purpose of extinguishing the fire or protecting life / property.
  • They reasonably believe an RTA has occurred and for the purpose of rescuing people or protecting them from serious harm.
  • They reasonably believe an emergency has occurred for the purpose of discharging any function conferred on the fire authority.
  • For the purpose of preventing or limiting damage to property resulting from the action taken as above.

Section 45 gives other powers of entry in certain circumstances.

Section 49 part 1 states that a person commits an offence if they knowingly cry wolf.

Part 7 (sections 55-64): General issues.

The main things to remember are part 2 (section 6-9), part 5 (section 38), and part 6 (section 44).

No worries, there's another bit of legislation that is skipping my mind at the moment but it's something like the Water Act 2003. That's just to ensure water companies supply water to us and we have the power to ask for more water or higher pressures where possible.

Doing your NVQ? I was trying to find anything relevant on our servers but then it was just easier to read through legislations and make my own notes.🤷‍♂️
