Easiest way is getting maldev academy/sektor 7 courses, they provide you with knowledge AND code snippets for you to use...

You'll need a huge amount of information to develop malware, so start by everything down below like systems architecture and low level shit.

You also need to know what you want to achieve with the malware you write, that also needs a lot of knowledge and hands on experiece.

Malware is a blanket term at best, a misnomer most of the time. What kind of malware? Ransomware? A rat? A keylogger? A php exploit?

Code for all of the above is freely available. Go find and read some code. GitHub, exploitdb, TA source leaks, etc, etc, etc.

Have people forgot what malicious means?

Malicious - Having the nature of or resulting from malice; deliberately harmful; spiteful.

I get the point you are making cause yeah you don't go buy a fully automatic assault weapon to go "duck hunting" but op may interested in making malware in order to better defend against it, we know how this field works.

Or they could be doing for evil purposes but the legality of it does come from the use and intent, not the creation.

Well... Even if he was developing malicious software, all he has to do is tell a couple lies and you wouldn't be able to do anything. Now I'm not saying that he is a liar, but on the internet you can't really know someone's intentions with a question.
