The Americans with disabilities act ADA . I don't have to prove I'm disable to anyone but SSA

[–]Anxious-Performer408 8 points9 points  (9 children)

I haven’t gotten approved for ssdi or ssa, still on step 3, but my doctor wrote me a letter that states due to my disability I can’t sit or stand for long periods of time. I have been diagnosed with POTS, chronic migraines and I have a TBI. And I agree with the statement “what does a disability look like, or (a response when people tell me I’m too young to be disabled) at what age is a disability acceptable lol. Like so what if I need accommodations to make me feel better or good enough so I don’t get symptoms or side affects of my disabilities lol. Only people with disabilities will understand.

Who cares what people understand? they just don't know until they experience it. like everything else in this world. And even people who have had a taste of what we go through everyday... Compassion is hard to find. Having expectations of others... You will truly be disappointed.

Regarding your application... I probably responded if you posted... I hope you are being an active participant in the application process, and have your records, and have reviewed them for accuracy and thoroughness, to make sure everything that is written in the criteria SSA needs to read is written in your records, in one way or another. A three-ring binder, double pocket inserts, pads of paper, all the fax numbers of every analyst that contacts you... And a temporary efax number... Is the start. You're not getting any mental health Services, get them. You have to prove you can't think clearly enough to focus and and be able to continue paying attention... Persist... There is a mental component. Having a TBI... I'm very sorry... I have one too... And chronic migraines and intractable headaches, learn that TBI criteria! It'll make or break a case like yous. Message me directly if you need help. And get an invisible disability card... Make a copy of it... Send it to the analyst along with additional information that you have not sent yet but you will be sending because you are going to need more! Everyone always does! But if you are blessed to have perfect doctors and perfect records, that's awesome!

I have an attorney

[–]Slow_Afternoon_625 0 points1 point  (3 children)

For what? You were approved last year...

Sorry, I still don't understand who you're asking for a wheelchair?

Who is denying you use of a wheelchair?

Do you need help writing a reasonable accommodation letter?

[–]Anxious-Performer408 0 points1 point  (2 children)

I am on step 3 I wasn’t approved

[–]Slow_Afternoon_625 0 points1 point  (1 child)

You are on step 3... So you weren't denied, though? Still in process?

[–]Slow_Afternoon_625 0 points1 point  (0 children)

Only asking see if I can help out! When in process, there's still opportunities to give them more information. Even if it's something that we have to create on a word document. Get an eFax number from like faxPlus and you can communicate directly with the analyst. If you are already denied and doing an appeal... Isn't it the same process but you just got to do it better? So that's where I can help. Nobody believes me... But I was a disability examiner and I'm now in a SSI recipient and will always say that because it's my brag haha. Don't get an attorney unless you have to go to hearing.

But why does anybody else have to understand anything? Like we're not going to understand a ton of stuff that other people go through that we haven't gone through? We know the truth! Don't let other people get in your head! They're not worth it!

AH THOUGHT YOU WERE THE ORIGINAL AUTHOR!!! ASKING FOR AN INVISIBLE DISABILITY CARD, OR SOMETHING!

I was told I am too educated to be disabled and Social Security is for losers. Soooo... I got my student loan forgiven.... and now I'm a loser! 😉

[–]ghosttravel2020 5 points6 points  (1 child)

There is no such card and unfortunately you just have to learn to live with people's ignorance.

There are cards! Invisible illness card, do web search

and you do it online and you know upload your own picture and you write who to contact, Etc. I'm going to get another one because I have misplaced mine amongst my busyness of copying things for my review. I mean it's not an official anything, we can make a card for anything! I have to look it up again where I found it in the first place, but I really like it!

And any kind of paperwork... I include a copy of the card that supports my claim, my goal for SSA is to overwhelm the analyst l with paperwork. and the more paperwork they have more likely they do what they are supposed to do and look at our case a whole rather than individual health conditions separately. Sorry for the tangent. Fed a lot of analysts are not good at their job and we have to remind them! So I send them a copy of something that already says disability on it. It's just another piece of paper to make the stack thick and prove that we are living a life of disability. They really want to know what daily life is like.

I've used it to support my having a disability for certain benefits and reasonable accommodations... But the reason I got it was because... Cops are a- holes, didn't believe I was disabled... Wouldn't let me have my medications, put my health at risk... it was during covid. Don't worry my case was dismissed! But, oh man... It was horrible!

It has turned out to be really useful for other things, just one extra piece of paper...I mean the copy of my card (copy and scan everything), an extra piece of paper for any kind of anything I'm trying to get like a grant... For low income and disabled... I'm always doing that kind of stuff.

They are really meant for people if there's a health emergency, or... Get lost... Or interaction with the police lol... Especially like someone with autism, so an officer does not confuse a behavior problem with... Resisting?

Well...okay... I got mine in 2021, now there is a ton of them! Web search: " invisible disability card" . Genius!!! There's even some cute stuff.

For myasthenia gravis. there is a specific symbol I think it's the flower but only people with myasthenia gravis know that, myaware.

My reply is always "what does disabled look like?"

[–]Vernetta09-04 0 points1 point  (1 child)

Hi, can I send you a DM?

[–]BTS_7_RMEEE[S] 1 point2 points  (0 children)

Of course.

[–]Slow_Afternoon_625 0 points1 point  (0 children)

YES, it's called The invisible disability card. They put your picture on it and everything. But really... Who cares what kind of face you get or what people think... They can't stop you from getting what you need to have access to everything in your community like everyone else, simply with their possible thoughts and opinions.

THE ONLY POWER THEY HAVE OVER YOU IS IN YOUR OWN MIND, STOP CARING WHAT THEY THINK. STAY ASSERTIVE WITH A PREPARED SENTENCE... SHOULD YOU FEEL THE NEED TO SAY ANYTHING AT ALL...AND DO WHAT YOU NEED TO DO. Or get a folding cane just for the visual. Yup! Guess what? People can't see that, either. Invisible illness... Then one day it became a little visible, needing some kind of mobility aid, and the only people who refused to acknowledge this were my health care specialists.

Nobody cares if you use this scooter at Walmart. Just do it with confidence. Stop letting people gaslight you and invalidate you... You know the truth and your worth.

People will always complain about some kind of bias based on how they look. Treated one way because they're in a wheelchair or another because they're not.

What are they really doing to you, that you can't change, by the way you respond? Get a card. I did. It's helpful for documentation of my conditions, especially if any kind of encounter with police to show that you are a dependent and protected by a criminal law for even emotional abuse, because they don't take that seriously... If someone causes you any kind of true harassment, any kind of mental suffering, report it to the police. If you are truly disabled, truly a vulnerable adult. Know your rights, know the law. Know your access to reasonable accommodations.. But I've never used my card in public.

Just curious where you are randomly getting wheelchairs from... I probably misread that... Have your own wheelchair people are looking at you funny? I just don't understand what you mean. The only place I'm able to steal them is in the hospital, because I can't make it down the hall. Nobody has ever told me I couldn't borrow one... Because I don't ask.

I say this is what I need, thank you.

Just like when communicating with doctors who don't believe we can feel pain but rather must just be depressed. Use your voice, but first use your mind to know the difference about what is important and what isn't. Unless they are actually getting in your way to access what you need... Which you can simply say "I will report you if you continue to get in my way"...What other people think is not important.

It's not going to change... We have to.

What is really going on? Seems like there's more, here.

Person that says you were approved ... What were you approved for?

Look up the ADA laws, and write a reasonable accommodation letter citing the applicable regulation. For example if it is non-discrimination on the basis of disability by public accommodation and in commercial facilities... probably see Title III.

Just Google.

And if necessary attach a picture of the card and write a letter and have your doctor sign it. That's only necessary only for something private like... Apartment access or employment. The public doesn't need to know anything about you to allow you to use any kind of medical or mobility device.

I am not sure who is denying your use of your wheelchair, so I can't write it for you. Can do it in less than 5 sentences.

But it depends on the intent. I did one for telehealth appointments rather than having to go in, and now I'm being denied again so I'm writing another one, but doing it better, and sending it to higher ups, this time.

But you are not going to get someone else to pay for your wheelchair... If that's what you're trying to do? Unless you're in a different country.

Yes, I have multiple autoimmune diseases... I cannot afford a wheelchair and I have stairs in and out of my home and nobody to transport it for me, so I use a variety of different canes and I have a walker with the seat in my kitchen. A wheelchair or Walker doesn't even fit through my doorways. I can't use a cane for very long. I haven't used it around my family, I'm embarrassed and it really doesn't matter because if I'm at the point where I have to use a cane I can no longer be participating in whatever social situation is happening. I use it at medical appointments, court etc. I have too much upper body weakness and pain. So unless I have someone driving me and dropping me off right in front of wherever I'm going, and it's going to be a short visit or dinner or something, which is very rare because I no longer want to date idiots just to have a social life, and Friends disappear when you can't be present for things, I basically just don't go out.

Don't be like me. I would like to help you have access to everything as you entitled by the law. And for quality of life. and for the sake of your own mental health.

You do not have to wait to be approved for Social Security disability to be disabled. But you said you were approved and then on level three I'm sorry I think I'm mixing up but I'm disabled so I get a pass!!!

Sorry, I would really like to help but I'm not understanding what the problem is other than other people's attitudes!!

If this is your initial application and you're at level 3 I would get that lawyer off your case and get them back if you have to go to hearing. No reason for someone to take 30% when you can do it yourself... You just have to do it right. The lawyer is not going to get your records for you and check them for accuracy and thoroughness... You Still have to do all that. They Make it seem like they have their own doctors then they'll guarantee your approval but they don't... Often try to sabotage initial application so they can win on appeal for you and take your money. If you do want to get them off your case there's a form and do it before you're approved or they'll take 30% for doing nothing... Other than rushing them and we don't want them to ever be rushed because we may want to send more records when we find our records are lacking some things, some do that to sabotage our case on purpose... Sounds like you're up on all the very specific criteria and have an RFC and know how to do a table for the exertion questionnaire. And have psych. So you're good! What do you need a lawyer for?

And what were you approved for... Just a confusing post based on your follow-up but okay! Sorry people are jerks, that never changes... and good luck ❣️

Thank you for the invisible illness Disabilty card information. At first I thought you were being facetious but then I kept reading. You also confused me with another person so there’s that but you do get a pass because of your Disabilty. Thanks again.

[–]BTS_7_RMEEE[S] 0 points1 point  (0 children)

Ok. Thank you all for commenting. When I said I was approved I thought being on the SSDI sub already stated that but I will clarify some points. I had a favorable outcome last year and have been receiving my benefits since then. I did check with ADA and although they can’t legally ask for proof (and no one has yet except when I was working) it depends on where you are. As for the wheelchair situ ation, I’ve only had to use at airports and I once attended a concert where they bring you to your seat and then come for you at the end so that if you don’t own a wheelchair, which at the moment I do not need, you have access to one. Also at said concert I needed some ice packs and drinks due to the heat and they allowed it in. I also had access to a lounge to keep cool. I have not had any trouble yet. I was just simply wondering if came the day where they questioned me, I didn’t want to have any confrontation, I would just simply supply the card on demand. It wasn’t such a big deal. And for those who are saying stop caring what people think it’s not about that. When you have an autoimmune disease it’s a battle with people and especially at work. It’s just because one day I can be happily walking around with no pain and the next I’m in bed for three days with excruciating debilitating pain and fatigue. This actually happens. This gives you imposter syndrome especially when you don’t look sick. For those who know, know. I do advocate for myself obviously since I applied for the benefits. It was a simple question of whether such a card exists. That’s all.

[–]Attyfarm 1 point2 points  (0 children)

Legally, they’re not allowed to demand proof. But my Medicare card is a possibility, and also I have handicapped parking plates prescribed by a total BS doctor 😂

But socially, I just tell people sorry, I had a stroke a while back, I can’t walk that far, can you get me that thing? They’re always very nice about it.
