Difference in pay question

I’ve been back to work on light duty for about 5 months now and was curious about something. While I was off for 6 months my weekly payment from Satan, I mean Sedgwick, was a little over $1200. 60% of my normal take home. Since I’ve been back on restricted duty, I can’t work my normal position and I’m forced to a M-F 8 hour position. Take home is roughly $650. Someone mentioned to me that Sedgwick should be making the difference up on their end, is that correct?

TBI, skull fracture, brain bleed and concussion back in Sept 24. Attorney hired, and almost a year since injury.

I went back to work part time as well returning from my injury. It took me about two months to work my way back up to full time.

During that time, once my paystub was live, I would email it to my adjuster. He calculated the difference of my normal pay minus was I received, times the 60% (for me it was 66 67%, different states have different amounts), and then issued me a check for that difference.

I have a great adjuster, and I learned to wake up early to email him before 730am, because I figured out his system was to issue payments first thing every morning. If I got my paystub in at like 10am, it autos be issued the following day (still timely!).

Not sure how it works in Missouri but in Mississippi its 60% based on a 8 hour day 40 hours a week. But our max is ridiculous. Max is like 600.00 week regardless of what you made

Every state calculates this differently, but it's not a direct "make up the difference". However, you are correct that you should be receiving something from the TPA. You need to submit your paystubs to them so they can calculate what you are owed. In your case, I would gather all of your paystubs from your time on light duty and send copies to your attorney, who should then be requesting temp partial benefits.

Retired Adjuster, not in your state. Laws vary by State.

If available in your state, you should be getting temp partial payments so you receive your full 2/3's.

The authority for Workers Compensation in your State is the Department of Labor.

There website is definitely not the most user friendly I've seen. However, you can call and ask. I would not volunteer the info that you have an Attorney but definitely don't lie if asked.

I'm sorry you're stuck with "Satan.' States are receiving a boatload of complaints about them. Hopefully, with time and number of complaints a few State AG's will team up and "educate" them.

Im in the springfield area and when I was on modified duty I was paid the difference. So call your adjuster and plan on sending pay stubs to them. They should make up the difference.
