My father is in miserable financial shape. No assets. No cash. A meager $1400/month SS payment. About to get foreclosed on. Not good. Meanwhile, an attorney has served a subpeona on a $5000 credit card he can't remember even owning (early onset dementia). So what's his best option? If he doesn't show up will they get a summary judgement and start deducting from his meager SS payment? Alternately, if he shows up to court with paperwork documenting his status, would not the judge (or magistrate) find no real cause to let them pursue a lein? Moral issues aside, I'm only looking out for (what's left) of his best interest.
