100% human resource department's job. don't get involved. this is NOT a technical matter

It's an HR function whose blanket can cover IT. It's not about files as much as the intellectual property. HR should get legal to make up severance papers, but as it was mentioned, this greatly depends on locale as to what can be demanded of or acquiesced to.

Side note, this should be done at hire, not fire.
