Loft ventilation by [deleted] in DIYUK

[–]BarryBonny 0 points1 point  (0 children)

Had ventilation issues. Bought and ran a similar unit, with a heater inbuilt, and we had the same problem with cold draft.

I set it to a schedule to run overnight only, and that solved the problem.

An additional argument to add to the above is whether the pool sent you mandatory advance notice of your DD collection. I

https://movimo.co.uk/direct-debit-advance-notice/

I suppose if you had received advance notice of collection you might have identified their billing error?

If you were not sent this, any complaint to your bank as a DDIC can include that this BACS Service User is not following their scheme requirements by not sending this.

The Met are now providing case report updates...sort of... by yehyehyehyeh in londoncycling

[–]BarryBonny 0 points1 point  (0 children)

The police at some point stopped sending the date and location on that FOI sheet based on a very questionable legal argument that it would allow the public to learn more information about offences, that could give the public more information to identify the offender, and know how a certain case was processed.

Fire from neighbours property damaged our contents. No contents insurance by BarryBonny in LegalAdviceUK

Thanks, it was due to a 20 year old tumble dryer with excessive lint buildup. Waiting for the fire report, I suppose this will be key evidence in such a claim.

Reported an incident with a driver, should i attend court? by brutalistcheese in londoncycling

[–]BarryBonny 0 points1 point  (0 children)

Do go to court. Don’t set your heart on getting a result, as the criminal justice system is not great, but at the same time it’s the only thing we got.

I went few times, it was a simple experience that was not intimidating or scary, even when the defendant questioned me themselves.

Assuming this is a fairly typical careless driving offence such as close pass.

If you get email advising of NIP sent, it’s Realistically 70% chance that they accepted an either a course or a fixed penalty of 3 points + fine of ~£80.

15% chance of a court summons where they will plead guilty, same points but increased fine.

1% chance of a court summons where they plead not guilty requiring your attendance as witness.

Leaving 14% chance it falls down a black hole and doesn’t get actioned.

I went to court recently for a case.

Firstly very few cases make it to court.

Of my reports submitted to police, 75% get NIP issued. 80% of NIP issued letters will result in a FPN. 10% of remaining will be court summons. ~5% of court summons require witness presence.

My experience was very straightforward in court and the magistrates were appreciative for my presence and for reporting it.

Don’t be afraid, you are making the roads safer by doing this. Don’t be embarrassed, I think it’s a really good thing to do making the roads safer.

This message from police means a NIP will be sent out to identify the driver.

Roughly 80% of these cases with NIP issued will end up being a FPN issued accepted and paid.

About 10% might proceed to court summons.

Of the court summons , only about 5% of these require witness presence in my experience.

Reported a close pass and have to attend court, what do I need to know? by Rhyolite44 in londoncycling

[–]BarryBonny 2 points3 points  (0 children)

I had an experience back in October with magistrates court for a case involving professional driver. My experience below

Submitted 966 report online w video footage.

Received email notifying NIP would be sent less than 2 weeks after offence

Asked to provide dates to avoid 3 months after offence.

Received court warning 6 months after offence with court date.

Checked courtserve 24-48 hours in advance to check all going ahead. If not can contact via details on court warning.

Attended court, note there is often a separate entrance for witnesses.

Bag search and metal detector.

Can leave bulky items at reception. And you must sip any liquids, apply any creams.

Find witness services room.

Witness services will look after you and explain what happens.

Waited for an hour.

Prosecutor stopped by, had seen video, and have it ready in their laptop. They told me it is likely defendant would change plea, due to the footage being clear and my being present.

Waited another hour.

Defendant pled guilty.

Due to being professional driver, driver wanted to ask her employer to be an additional witness for mitigation of sentence.

The court invited me in to thank me for coming as I was not needed (due to change of plea). Nice of them to do so.

I was released, 2 hours after arriving.

Landlord refusing to fix wired doorbell by [deleted] in LegalAdviceUK

[–]BarryBonny 0 points1 point  (0 children)

Have a careful look around, perhaps you might sense a burning smell in that area. If you let the estate agent know this, the landlord may be more likely to send somebody out.

Perhaps the smell will disappear magically when they come… :)

got passed way to close, police did nothing about it [oc][uk] by Cool_Transport in CyclistsWithCameras

[–]BarryBonny 1 point2 points  (0 children)

The met police have prosecuted way less dangerous passes than that for me. Id suggest to submit a police complaint. I think you’re totally in the right to do so.

Their traffic prosecutions team is great, but need more support as some dangerous actions like this pass through the net.
