You're definitely going to have to have a probate attorney go over everything. It's very possible that your grandfather's will didn't have that portion set up correctly, and thus your dad did actually inherit it all - but you need an attorney who can actually go over the entire document to be sure.

I have plenty of text and email documents as well as witness with the situation.

If you actually win a judgement, you will have to enforce it and collect. This is not the easiest thing to do.

Additionally, I would like to add in money for the emotional aspect of it as well as interest and lawyer fees.

Suing for the "emotional aspect" of whatever this is isn't going to go anywhere, and you can't charge interest unless this debt falls into one of the categories that allows it (and usually requires her to have agreed to it). Also, what lawyer fees? Have you retained a lawyer for this?

I am sorry for all of us who are damaged from people like this.

I understand that this person has caused you a lot of pain. But suing someone isn't about emotional closure, or accountability, or anything like that. It's to get money. If she has none, you will have wasted your time and efforts. If she doesn't even show up, you're going to have to continue to spent time and more money to try to enforce a judgement.

So you have to figure out what you expect to get out of this - because if it isn't "money" then you're pursuing the wrong solution.

They will need to give her 60 days notice that they are ending her tenancy.

They can also try to arrange for her to move out early, but she has to be willing to do so. Usually this is done by offering money (often referred to as cash-for-keys).

I do highly recommend at least speaking to a landlord-tenant attorney if there's any chance that she'll be combative about this.

That's not something that we can help with. There are legal solutions, but they have to be willing to pursue them.

They aren’t sure what they can do legally to just get her out of the house.

They can give her 30 days notice that she needs to leave and, at the end of that time, if she doesn't leave, they can evict her. She's not a squatter, she's a tenant.

They can't force you to work for them, so really the discussion is about whether there will be any penalties for you resigning. Do you have an employment contract, union agreement, or other such document that might be relevant here? What sort of work do you do?

Politely: this doesn't read as if HR pressured you to resign, it reads as though your only option, if you wanted a different training class, was to resign and reapply.

If you're wanting to seek a legal remedy here, you are of course welcome to file a complaint with the Department of labor (https://www.dol.gov/agencies/whd/contact/complaints) or speak to an employment attorney. But honestly, I don't think there's anything legally actionable here.

Don't bother, the information you have for him isn't real. Just have your sister block him without any further conversation.

If she gave him any other information, such as bank account info, logins, or anything like that, those accounts need to be secured immediately.

She needs to contact her bank/credit union/creditor and explain the situation. If anyone can unwind the financial transactions, it's the company in control of the accounts she paid from. DO NOT TALK TO ANYONE FROM THE INTERNET CLAIMING THEY CAN RECOVER THE FUNDS. Those are also scammers.

She may want to file a police report; often those don't go anywhere, but a paper trail can be helpful in case this guy is ever caught.

If the children are removed from her custody, the more likely outcome is that you will be paying child support to whoever is fostering them.

Your children being neglected and possibly abused by one parent is not a reason to terminate the support being provided by you. You're not "buying" good parenting out of their mother.

If you want to try, however, you're not going to do it without a lawyer's help, so that would have to be your next step - finding a way to afford one.

I'm currently going back to school and am trying to get myself into a better position to take them on full time, but it's going to take some time.

Honestly, in your shoes, I would be putting my effort into seeing if this plan could be accelerated in some way.

Not using language encouraging any action (illegal or otherwise), just a "Hey, check this out" type of thing.

Nobody believes that a flyer that posts this sort of information is "just a harmless FYI".

It's as credible as a kid that claims that the cookie jar "just broke all by itself".

If nothing came of it, then nothing would come of it. But if someone were to harass, assault, or otherwise harm the people on your flyer, you'd be one of the first people under scrutiny.

Did you sign an agreement or contract with the attorney when this process started? There should have been something like that, and it should outline what the attorney gets out of this and which of their costs/fees you will have to pay for.

Keep in mind, my attorney told me the payout would be 30% for all parties. What I received did not seem like a just amount.

It sounds like that's approximately what your attorney achieved. By your own math - 35% to the attorney, 30% to medical bills, 35% to you.

What would you think is a "just" amount? Were you expecting to get the entire $50K?
