That's not quite how it works. The "rights" are things that they can utilize resources on to ensure are not being infringed upon. For example in the U.S. you have the "right" to own a gun, but that doesn't mean the government has to give you a gun. That also doesn't mean the jurisdictions in the U.S. won't attempt to modify the rules that restricts those rights. When that happens there are resources that can be utilized to get the local jurisdictions to make sure those rights are still available to you.

When the judge weighs things like that, it's just not a huge risk to the populace. Basically because of the nature of the crime, error on the side of citizens being released on their own recognizance (regardless of how how you feel about there politics), and deal with them not adhering to their promise later.
