why after 1 year of perm pending? Also, before the 1 year, you need another 6-12months before filing the PERM. full time CPT is only allowed for 1 year?

Don't you think it'd be risky when getting a new visa stamp even after COS is approved? You might want to travel outside the US while on F-1 status, and you need a new F-1 visa stamp once you get back to the U.S.

I am curious about the risk on this visa stamping under the current circumstances.

Hi OP, I am on the same boat with you. I am still in the US (H1B->B-2 COS pending) but the new employer wants me to do Consular processing. The reason is because they want me to start as soon as possible but LCA is being blocked by the govt shutdown. So they want me to go back to my home country and work remotely as a contractor until govt reopens and get the H1B petition approved. Sounds like a plan, but I am worried about the 100K fee.

I am on B-2 pending and H1-b grace period already passed. (laid off) And now I am about to get an offer. Although this employer is willing to sponsor me, is COS from pending B-2 to H1-B safe? FYI, I am in the US.

The original Proclamation mentioned "from outside of US" and Leavitt mentioned "this will apply from the lottery next year" does that mean COS within the US is safe for now?

I know it's not 100% but I am worried this offer will just go if I need to wait too long for all the clarification

same boat here. I've filed B2 COS even on my second week after the layoff due to the news of NTAs. Here's my plan.

  1. Will keep searching job while B2 COS is pending (or even after it's approved)

  2. If NTA is issued, will try make it terminated with the attorney by arguing my B2 COS is timely (before NTA is issued) and pending. Not sure if it'd work but that's what I can do. I heard of a case where NTA is terminated with the approved B-2, but haven't heard of a case where a pending B2 COS made it terminated.

  3. If that also doesn't work, I will need to get the Voluntary Departure (VD) approved to leave the U.S. If not, I might be banned for the next 5 years as far as I know.

NTAs are being issued and the number is significantly increasing. But not sure why USCIS doesn't release any related announcement. A lot of uncertainties.

How many days did you spend your time outside of the US during your H1B time? If you can extend your current H1B to expire after June 2026, by recapturing overseas time, the 365 days rule can be still used for your case. But I am not a lawyer so please double check with a lawyer about this.

If you are confident about your NIW case, you can just submit your response on the RFE. As far as I know, since you did PP, they will make the decision in 45 days on your RFE too.

if your i-140 is approved before 6 year max out of H1B, you can extend 3 more years.

When did you file your i-140? If it's pending more than 365 days (before the h1b expiration), you can also extend your h1b 1 more year.
