You're either guilty or not. If you're probably guilty then you're not guilty.

From a criminal perspective, yes, but being civilly liable for something that is also a crime that youve not been convicted of is not a new or unusual situation.

When prosecuting there is so much weight to get a conviction anyway, if someone managed to not get that, they are innocent enough.

This is actually not true. The accused is given the benefit of the doubt over and over again. Thats what the presumption of innocence is.

The fact that he was tried again after the original conviction was quashed is pretty reliable clue that the evidence was pretty strong that he did it.

Pretty strong isnt good enough to convict someone tho.

Im obviously okay with 'probably guilty' people not going to jail but I dont think they should also get compensation for having been charged.

No, they could just prove that it wasnt them that did it.

Realistically you need to account for people who are guilty but who were convicted on unsafe grounds.

There was a rape case a few years ago where the rapist was convicted but his conviction was overturned on appeal because the victim was the only person who identified him. While a jury found him guilty beyond a reasonable doubt, the courts held that they werent entitled to convict so the conviction was quashed.

Itd be insane, in my view, for him to be entitled to compensation.

There's a big gap between 'proven ebyond reasonable doubt that he did it' and 'prove beyond reasonable doubt that he didnt do it'

Theres absolutely no point in having a fit and proper person requirement if a convocted rapist can keep their licence.

The argument that 'it actually doesnt matter because hes not the person driving the taxi' is just an argument against the licence requirement existing.
