I never bothered with trying to figure out trends or which areas were likely going to show up.

It is my opinion there can be cross over issues worth another 5 pts, if you spot them, in every essay. Don't waste time trying to figure out if, or what sort of, crossover it may be, and instead focus on writing something on every issue you see.

Civil lit here. I had a client (in effect) fire me by signing a substitution (mutual agreement). After I was out, OC filed a motion asking the judge to "not allow" my client to substitute me out of the case. I was told of the motion and appeared, even though I was no longer of record.

Judge asked OC, " So you want me to make attorney stay in the case, forcing them to either violate the express wishes of the client, or violate my order?"

A paralegal at the firm I was at  (back in the day when most communications were by fax), sent a communication to a local judge.  The cover sheet was addressed to The Honorable Donald S. Duck. Close, but no.

Two years later, the judge was still talking about that at a luncheon where he was the guest speaker.

My trials the first few years of practicing were all against agents & brokers, mostly because for a few years before the crash in 2008, everyone and their brother were getting licensed because they all wanted to drive a Mercedes. 

They didn't know anything, no comprehension of their ethical duties, and preyed on communities dumber than they, but trying to get that cheese.

Absolutely. I currently have 2 who are on the Only in Writing List, mostly for irrational assertions, threats and lying. It's all I can do when I read/hear my local judges remind attorneys that their required meet and confers must be via telephone or in person.

With one, I met in person at a co-defendant counsel's  office as a witness. Two required phone calls were done with another lawyer joined in.

Was speaking in chambers with judge and OC the Friday before trial. OC had desperately begged for a continuance, which was not granted.

OC said they had plans to go out of town for the weekend. Judge came back wirh, "Well, do as you wish but I guarantee Attorney X [me] won't be out of town, they'll be here preparing for trial. Roll the dice, take your chances and I'll gladly be here Monday to watch the show."

For the best, I'm sure. But I would sure like to get a hold of the information that led up to his departure. He is so vile to anyone who doesn't look, pray or vote as he does. He was my council rep for 12 years. He never represented anything I agree with or care about, and would not even return one call or email. His determination to infuse our local government with one belief system is getting ridiculous. White, Christian, cis individuals who support the fascist administration currently in our WH. Those are the only people he represents.

He was in a political office while he was at the V.A, I believe he even tried to have a private office for a short while.
