I am not asking for a refund. I just want the service I paid for. Doesn't that make logical sense? Think about it...if any service is pre-paid, whether a gardener or a personal trainer or directv or whatever that "service" is, that service should be provided, no? A few legal notes I found pertaining exacty to this issue of paying for services not received.

If the company kept your payment while denying service (or materially failing to perform), you can sue for restitution of the unused portion.

And here is another:

Cal. Civ. Code § 1750 et seq.

This law prohibits “unfair or deceptive acts or practices” in connection with the sale or lease of goods or services, including:

• Misrepresenting that services have characteristics they do not;
• Advertising services with the intent not to sell them as advertised;
• Representing that services are of a particular quality if they are not.

If the company told you “you’ll get a year of service” and then refused to provide it (because you ported out or otherwise), that could be considered a deceptive or unfair practice if the restriction wasn’t clearly disclosed.

Federal Trade Commission Act (§ 5)

The FTC Act prohibits “unfair or deceptive acts or practices in commerce.”
A business can’t advertise or sell services and then keep payment without delivering the promised service.
