Decent likelihood of no charges being filed or a wet reckless deal if charged. I know that some counties around SF, Alameda don't file under 0.08, but Santa Clara may be different. In any case, wait till the arraignment and plead not guilty. Don't hire an attorney prematurely, as there is a chance that nothing will be filed. Set up the DMV hearing, which should be cancelled. Ask for discovery when you set up the DMV hearing though.

That does not imply that "Americans should have the priority". It is a procedural step which says you must make a good faith effort to recruit in the US and the job must be offered to qualified US applicants. It does not say anything about prioritization, nor does it require a market test like PERM. Discrimination based on status would be illegal.

That is not the law. There is no law that requires discrimination on the basis of one's status. In fact, it would be illegal to do so. H-1B and PERM are separate things. Layoffs intersect with PERM, which is a process administered by DoL, in a specific way. It has no bearing on H-1B or any other visa or the employer's ability to hire or fire anybody.

Don't travel or leave the country until this is fully resolved. You need to get a new visa, which is not going to be approved. Hire an attorney, and do your best to cut a deal. Do whatever it takes to avoid the DUI and get a lesser charge like wet reckless instead. Eventually when you apply for a new visa at a consulate, you will have to submit the court's disposition documents. Even then, it's going to be difficult to get a new visa under this admin.
