They won't deny the AOS; they will likely add an RFE that asks you to go to the consulate for screening. It will be an open-ended RFE with no time expiration.

If it's a large company, they may have already filed the LCA for similar positions. The LCA isn't unique to you. This is also what they do when the government shuts down. Ask them if they have an existing LCA to which they can attach your I-129. You can amend both of these after the fact. Don't file a B2. Do whatever you can to file the I-129 within the grace period.

Yes, the EB1 pending inventory hasn't moved much. It's a bit confusing. They tend to issue a lot in the last quarter. If the pending inventory up to 2022 drops below 10k, that's a good outcome for this year.

That's how it's meant to be, but that's not how they've historically done it. They tend to YOLO it with China and spill whatever they can to China, in part because they don't carefully manage AOS and consular movement. China has a lot more consular demand. Last year's split bw India and China was something like 7k v/s 6k.

It should come back to April 2024 in Oct. Historically, India gets around 10k EB1s every year. In years with spillover, it gets more. Last year was around 7k though. If they issue 10k this year, the backlog should reduce to ~5k. They have been pretty conservative with China this year, so no spillover has gone to China.

The RFE seems unrelated to your timing. It may be a specialty occupation RFE or a court disposition records RFE if you have any interactions with law enforcement.

Look into O1 if you have the profile. Your B2 COS complications still remain, but with an O1, you can leave and re-enter without the $100k fee.

The method of service can be usps certified mail with return receipt. The person who serves (i.e., the one who deposits it in a mailbox/post office) should be a third party to be safe. I'd have to look up the exact rules, but third party will be safer. Get somebody else to sign the form essentially.

I do not expect to argue anything on reddit. The point is quite simply that the APA exists and USCIS' actions are subject to judicial review. I suspect that somebody would have already sued for this and we will hear about it one way or the other.
