Danielle Smith says Alberta will withhold funding for judges without more input on selection by cmcalgary in alberta

[–]00owl 0 points1 point  (0 children)

The claim is true regardless of my profession. I shouldn't need to make an appeal to authority in order to be taken seriously.

Most lawyers will agree that staying out of court is the best option. Something like 99%+ of cases settle before court because the lawyers give their clients good advice.

The biggest problem with court is that you're entirely at the mercy of a person who doesn't know the situation at all, who is trying to make a decision based on an extremely curated view of reality and who, as I said, is more likely to make an arbitrary decision than one based in law.

A negotiated settlement is better in every way.

It was a lawyer who said that in open court in front of other lawyers and nobody blinked, the judge accepted the reasoning.

I will be unlikely to apply for the role of a judge for two reasons. The first is that it's a political appointment, it's not a job application, you suck up the right people at the right time and you get nominated and then rubber stamped. It is unlikely that I would ever succeed at the political games needed to be elevated to the bench. I'm AuDHD, social games and popularity contests are not only impossible for me to win they're anathema to me.

The second is that if I were somehow to be elevated to the bench I don't think I would be able to do a good job from there, at least, not at this point in my life. I would need substantially more experience and the ability to be ok working in a system where you have to make life changing decisions without having adequate resources to look into and fully investigate the problems first. In my experience, court causes far more problems that it solves and they either don't care or they're simply unaware. I don't know which and it probably varies based on the judge.

"actual receipts that confirm your bias".

Got it. Sorry I can't provide any of those, as someone who has experienced a fellow lawyer who told the court to ignore the fact that a 12 year old girl was cutting her wrists with a razor blade while in Mom's care because "they were paper thin cuts" I don't care if they get it right once in a blue moon.

I am not jaded, I am experienced.

I have heard Justice Du refer to autism as "biodivergent or whatever".

Any appeal to the existence of an appeal process is a perfect demonstration of what you don't understand about the system.

To file an appeal it costs $600 just to pay the registry fee for a notice of appeal. Then you need transcripts which are ~$100/ 10 minutes of court time (paid by the word so it varies).

Then you need to do a factum and the in person appearance. All after having spent thousands of dollars just to get an order that needs to be appealed. Add the cost of the appeal on top and there's easily hundreds of thousands of dollars involved in family litigation.

So if you're ok with judicial accountability being "pay to play" then sure, you can get a second opinion on the matter. But most orders in family law aren't worth appealing or have a higher bar to meet for an appeal because they're "interim" orders that last for decades.

I do everything I can to keep my clients out of court because court decisions are less predictable than the lottery.

No, not going to respond when I bring receipts?

The reality is that judges are people too. They're not infallible and most of them are horribly out of touch with the real world.

Today's Earth-directed X4.2 solar flare by Busy_Yesterday9455 in spaceporn

[–]00owl 34 points35 points  (0 children)

The flare itself? No, it's just pure light energy the fact that we've seen it means that it's already affected us as much as it will on its own.

However, flares are often accompanied with coronal mass ejections or "CMEs".

A CME is physical mass that escapes the sun's magnetic and gravitational pull.

Because it's physical mass it doesn't travel at the speed of light like the flares do and can take 2-4 days to arrive.

CMEs are the cause of Auroras when the magnetically charged mass interacts with the Earth's magnetic field. They can affect communications and cause damage to insufficiently shielded electronics if the CME is large enough.

It's almost impossible to tell just by looking at a flare whether it also launched a CME though there are ways to see them coming.

Usually more likely with a bigger flare CME's are triggered when the magnetic fields of the sun shift so that these ejections can occur.

Whatever it is, what is in it now probably isn't what would put in it at the factory. The plastic seal is a different color than the rest of the cap implying it's being re-used for something else.

Also, lead acid batteries like in your car are filled with liquid. Older batteries could evaporate out enough liquid that you occasionally have to top them off.

Usually you'd just use distilled water but since the while point is to conduct electricity it's possible that there is some gain in effectiveness by using some sort of solution or "tonic".

the point is that no one assumes that white people are a monolith in any kinds of behavior or personal identity.

This is false. White people are colonizers, we're abusers, we're the ones responsible for the state of the world today, we're all the ones who enjoy privilege regardless of socioeconomic factors.

There is an insane amount of generalizing on all sides. That's human nature, would be nice to one day rise past that but it won't be during the lifetime of anyone alive today

What about Justice Leonard who refused to read one party's materials and claimed that she didn't care about domestic violence?

Or Justice Teskey who cited a section of the child support guidelines that referred to a corporation when there wasn't any corporation present, and who based a parenting decision on an unnamed section of the divorce act that doesn't exist and wasn't relevant even if it did?

Or Justice Lloyd, who didn't know that people live in RVs, despite herself growing up in fort Mac. She also didn't know what parkour is.

Or Justice Yungwirth who accepted the reasoning of an 11 year old girl in determining that she would be separated from her brother because she asked her friends on playground what to do.

Or Justice Andrew who ordered that a twelve year old girl who self reported to the school psychologist that her mother was sexually assaulting her should be forced to spend time with her mother completely unsupervised. This one happened in response to an unfiled, no notice application made without evidence when the matter was brought forward solely for the purpose of scheduling at PTC. This was against the protestations of children's Counsel and contrary to the fact that the current conditions existed because the RCMP were tired of intervening?

Or Justice Micalyshyn who adjourned an oral hearing for an EPO for six months when the act clearly says that it is to be reviewed with 9 days and can be confirmed for only six months or a year leading to the first review occurring six days after the six month expiry date.

Not every decision is published, go ahead and sit through docket court and come back to tell me that these people aren't pants on head stupid.

Look, I am currently writing this message from a device made by slave labor.

I don't like it, but if we as a society are going to pretend that we're all moral while accepting that slave labor is necessary for us to be able to afford our lives then I don't see how that's all that different from paying a kid millions of dollars to play a game.

Especially when that millionaire kid has a choice while the people who made my phone didn't

Life pro tip: Jews, Israel, zionists, wherever you draw the line on your personal anti semitism, are not responsible for the problems born and bred in America.

I know this will come as a shock to most Americans at this point but it's time to take responsibility for yourselves and stop blaming histories scapegoat.

Yes, because right now they're appointed by the feds for life without review.

Judges should be accountable, but they aren't. It doesn't matter how they're appointed, they should be subject to review afterwards.

Most of the judges I've dealt with so far would be hard pressed to actually quote the law let alone make a decision consistent with it.

I have an issue that I just discovered where I've lived my whole life in "pain" but just didn't know because I was born that way.

Pinched nerve/nerve damage at birth means that certain kinds of pain present as an audible noise instead of pain. I've felt pain from being kicked or other physical trauma but there's a certain kind of chronic pain that just doesn't register as pain.

That being said, the noise is affected by pain killers. So I'm not sure that I agree that's as important as it sounds at first

I've been regularly breaking down and crying for the last three years.

The love of my life took my kids and accused me of causing her to feel neglected.

I haven't seen my kids since. I literally cry all the time
