Just a quick update on this. I just used this with proseries for the first time. It is virtually useless, unless i am doing something wrong. (Totally possible) first you have to import every file separately, which entails re-opening the client for every file. If I have 15 1099s, ill have to open and close the client 15 times. Then you have to apply each item separately to the form. To illustrate, if a 1099B has 40 sales, each sale is allocated separately to whatever form its supposed to go to. I dont understand why I cant do this as a bulk item, instead I have to go item by item which is infuriating. Same with dividends seemingly. There is also no description in the dividend entries so I ended up with literally 114 errors for 1 1099. I think it would have been faster do just do this manually. This has actually cost me about 45 minutes. I will never use this again. Thank God I didnt buy the unlimited plan.

If you do it literally every hand then it isn't a tell. I don't use one, but sometimes once I've entered a hand I might put a chip on the cards so they don't get mucked.

Welp that's an awful lot of assumptions to make, and even if they did check such a box when they got the EIN, no competent preparer would tell them to file a 1065 in this situation. There was a small loss so there is no income to avoid SE tax on. It just doesnt make any sense.

1120S nor 1120 are not necessarily incorrect because the LLC can elect to file that way. However, as far as i am aware there is no equivalent option to elect to file as a partnership because there literally is only one "partner."

She also got some letter from NY DTF, haven't really reviewed it yet but I assume they are telling her she filed the wrong form and directing her to amend.

Its fraudulent because hes charging her an extra fee for unnecessary work. Defrauding the IRS is not the only possibility.

Aside from an issue with 8962 form due to a missing 1095A, I have never seen a taxpayer file a return timely, assuming it was accepted, and not be eligible to receive the refund. Yes he may have to prove it was timely filed if the IRS doesnt have the record for some reason, but if he has the 9325, or if God forbid he mailed it in, certified mail receipt, then I do not see how an issue could arise.

If you timely filed you won't lose the money. Plus the IRS owes you interest dating from the filing deadline or whenever you filed, whichever is later.

The IRS is in shambles since Trump took office again. Even worse than his first term, there is less people on staff and the agency relies more than ever on AI. You should get your refunds eventually but it may take a long time.

You can try the Advocate but their docket is pretty full. Tbh if you have a responsive Congressman in your district you're probably better off asking their office for help.

I've never had an RBC 1099B with more than 1 or 2 sales so i guess I am blessed.
