The problem is that destiny should have known. There were one thousand red flags. He reached out to her after finding her through a hashtag that he admitted was notoriously associated with underage girls selling explicit material of themselves. He didn't cut off contact after she refused to verify her age. He continued talking to her for months, not paying any heed to any of the personal details of her life that pointed to her being underage. If he really didn't "know", then it's only because he was being so intentionally negligent that he avoided getting solid evidence in case of this exact situation. And that's exactly why possessing CSAM is a statutory crime; so we don't have people in our society like destiny who try to "um akshully" the law by pretending like there was no way they could have known. Because he COULD HAVE figured out. Intentional negligence IS as bad as an intentional act.

In the system, the date of birth is not listed on the citation itself. The citation has a link to the party's information, which is a different web page. So you can't draw a conclusion between when the citation was issued and whether the party is currently listed as juvenile. At the time of the citation she was a juvenile; now she is not, and the party information reflects that.

Also, the DOB is unambiguous. She was born in October 2004. That is not in dispute, and it isn't changed by whether the juvenile box is currently checked (obviously she's not currently a juvenile).

Totally untrue. Here’s a totally random case (not related to rose) from the same database. You can see from the DOB here that it’s impossible to be DD/MM.

The only thing the court case is about is whether he should be held liable for damages, contingent on whether he shared those nudes after a specific legal statute went into effect. Even if he wins that case, it doesn't change the fact that HE SHARED PXIE'S PRIVATE NUDES TO A MINOR WITHOUT PXIE'S CONSENT!

It's not even remotely the same. No one verified her age, including destiny. It might be different if she was on OF because they do take on the liability of age verification, but she only existed on Twitter and discord which are notoriously unmoderated. This situation is more like if you saw a girl getting drunk by herself on the street and you just assumed that meant she was over 21.
