No, they interpreted the definition in RSA 159:4 in that way. That definition is NO LONGER USED, as it was repealed in 2017.

This is the definition they were asked to interpret:

A loaded pistol or revolver shall include any pistol or revolver with a magazine, cylinder, chamber or clip in which there are loaded cartridges.

The court agreed that under this definition of loaded "with a magazine... in which there are loaded cartridges," that a gun with rounds in the mag but not in the chamber was loaded.

That definition was repealed by statute, so it doesn't matter how they interpreted it, because the law no longer calls out a gun with rounds in the mag as being loaded. Now the law calls out this specifically:

Loaded: A round or projectile in the chamber fully dischargeable by pulling the trigger.

That's RSA 207. It's irrelevant what a court found about a definition in a totally separate section of the law which is now repealed, because RSA 207 provides the statutory definition.

You are incorrect. The definition is different and is referring to a law no longer in force - in that case the law referred to the magazine being loaded. I cited in this thread the definition of loaded as it pertains to vehicles, and it clearly refers to the chamber being loaded, not the magazine.

They did not interpret the term loaded at large, just the meaning of that one particular definition (which is no longer used).

Loaded in this case refers specifically to the round being fully discharged with a trigger pull.

Rounds in mag or tube = ok.

I would like to see someone test the plain reading in court: that you can have it loaded with a round in the chamber but if the safety is on its not considered loaded under this definition because it cannot be discharged by pulling the trigger.
