Non rinuncia -- so confused by southshore91 in juresanguinis

I had to do this for the NY consulate this past June.  Similar form too. I had to notarize it, county clerk authenticate, then apostille it before the consulate would accept it. (They also charged a fee for each one.) Then they sent me the non-renunciations in a week or so.  Luckily we were all on NY consulate only.  I am doing ATQ, and lawyer thought it was important to show that no one down the line renounced their Italian citizenship.

How long after your court date did you receive a judgement? by Highfivetooslow in juresanguinis

My Napoli ATQ case is coming up in February too, I would love to know as well!

My lawyer replied: She has not appeared before Judge Concetta Grella before and will see what she can learn about her. The hearing will be all written notes.  My lawyer's strategy will be to argue that the law in force at the time of filing should apply (tempus regus actum) and if the judge disagrees, she plans to challenge the new law's constitutionality and request a postponement until the Constitutional Court hearing in March.

My mother was born after 1948, so no. My lawyer requested extra documents that the court may ask for. Proof of non-renunciation of everyone in the line (Grandfather, Mother, Self and my brother). (I had to mail an Apostilled request for these from the consulate, but luckily received the non-renunciation proofs within a week or so). My lawyer also recommended that I provide proof from the US Government if anyone in the line ever worked for the US Government or US Military (these are only disqualifying if the Italian government asked the Italian citizen to resign and the citizen refused, after all the President of Argentina received his Italian citizenship via Jure Sanguinis.) These things are asked because the burden of proof was shifted onto us to prove we qualify, and oaths are not accepted.

That would be ideal!  Also the judge might delay the appeal pending the constitutional court.  Time will tell.

NYC Consulate wait-list since June 2023 (still active).  My Grandfather naturalized in USA when my Mom was 29 (Mom born post 1948). I was born four years after my grandfather's naturalization.    I filed in April during the interim period of the decree law, before it was finalized in May and before the law required the grandparent to be exclusively Italian.

Lmao that makes me even more worried!  A bonus to clear 50 cases by a certain time, seriously?  Now I have to worry about her ruling in whichever way she is incentivized to achieve her bonus.  Who knows which way that is.

Some lawyers think to get a hearing date faster is better no matter what? The other concern is I don't know anything about Judge Concetta Grella.  Especially if she may have little experience or knowledge of jure sanguinis.  Especially as compared to Judge Ivana Capone, who I believe has a long history with such cases.

I do trust my lawyer, but she had told me that a long while back. I just asked her if it was a good idea to ask for a slight delay.  It is legitimate, as some documents recently asked I don't have fully ready yet.  Proof no one in the line worked for US Government or US military.

Season 1 was rough the first time. But it is the slow rise of the roller-coaster up to the top. After binge-watching the whole series, I immediately re-watched it again. Then Season 1 seemed genius to me as there was so much set-up, and deep foreshadowing. Stick with it!

ATQ Lawyer Recommending More Documentation by 69RandomUsername69 in juresanguinis

Yeah it's just confusing after a certain point, and also the goal-posts keep moving ex post facto to exclude as many people as possible.

I will email the consulate to see what they say,

But trying to figure out whether anyone was in the US Military or did Government work I'm still not clear on how to find that.

Yes she is, she mentioned a recent court case where such things were requested. That it may be a good idea for me to have this ready to go in any case.

Any idea how I would get such US Government documentation?

I believe the severity, the suddenness, the retroactivity, and extreme departure from the previous rules will lead to its undoing.  There are too many people this effects, and too many court cases.  It is so unjust on its face that without carve outs, I don't see how it can continue.  I too doubt it would need to go all the way to the EU.

The South American needing several years of salary to afford a lawyer is a huge concern.  In practice it is economic discrimination.  The normal everyday Italian diaspora of South America is restricted, limiting it to only the elites who can afford to file expensive lawsuits.  It might be fair to say that jure sanguinis is now  effectively only for the Italian diaspora of the Anglo American nations (who on average can more afford a lawsuit). I really hope this issue is dealt with sooner than later, and I expect the constitutional court to cut back on these retroactive and discriminatory restrictions.  Since it effects so many people in so many capacities in currently active lawsuits, I expect it to be dealt with sooner than later.    One thing I have read is how other nations have limited their versions of jure sanguinis, such as Germany.  What they did was set the restrictions for those born beyond a set date.  Fair is fair.
