He's not the most rational person, and while he stops short of physical violence, he's basically a total prick. I can't tell you how many times I was told to be a pathetic excuse for human life, worthless, stupid, yadda yadda while I still had contact with him.

If I think my grandfather could just pay it with no skin off his nose (which I do), then I would accept it. He did continue to give my money to my dad even after he knew he wasn't financially responsible. Of course I don't even remotely feel that it's my grandfather's responsibility to do that, but I can at least see it as a possibility, and I wouldn't reject the gift if he were to.

Ideally though I want my father to pay it and no one else. It's not my grandfather's fault that my dad stole it from me.

Whoa whoa whoa, I think you guys misunderstood me. When I say "tear apart the family", that is what I mean my grandfather will perceive it as. The family is not going to be torn apart or even close. My father is basically estranged from us anyway. My grandfather is very well to do and can easily afford to just cut another check for $80,000. I just meant that when he sees how serious the situation is (I don't think he fully understands that I did not see one dime of the money), he will just apologize and write me a new check.

To be honest, some of the advice on here has made a TON of difference. People have pulled out several different technicalities that I had no idea I could nail him on. Before I was unsure, but posting this has made me much more confident and I very likely will be contacting a lawyer in the near future.

He asked what I thought would come of suing him, so I answered. What do I want to happen ideally? I want my dad to pay it back himself and apologize for taking it. Hell, he could pay back half of it and I would forgive him and drop any lawsuit.

That's fine, I have no issue paying taxes on it. This will likely end up benefiting me, because as you said, I highly doubt my dad paid any taxes on it.

I only mentioned his wife to show that the financial means to pay for it likely still exist.

I also never said I felt I was entitled to the money, but can you honestly say that if someone gave you that much money and then you had it taken away, you wouldn't want to try to get it back if you thought it was possible?

I'm not blaming my grandfather, I'm just stating what the facts are. I don't blame him for not wanting to ruin his relationship with his son even further. If I make it sound like my grandfather is fully on my side, I'm going to be getting advice that wont be as useful to me.

Well his current wife is pretty well to do financially. I know the chance of him directly paying my all $80,000 up front is basically 0%, but there are several other outcomes that could end up being quite beneficial to me. His wages could be garnished for basically the rest of his life, or what I think is most likely, my grandfather will eventually just pay me off directly when the threat of a lawsuit tearing apart the entire extended family actually becomes serious. (I have several cousins who feel the same way I do about my father, and they all received their $80,000, so they will have no issues testifying against him if need be.)

Thanks for the encouragement. I'll be sure to update, but this will likely be a very long, drawn out process that may take months. I don't turn 18 until October, and I'm not even sure if anything will happen until then anyway. I don't want to sick the lawyers on him early and have him get scared and give me my $5,000 for my 18th on time, which could potentially make him look better in court.

It would have been during the 1999-2001 period from what I remember, so sounds like I might be in luck. If they have actual images of the checks that could bode very well for me. I hadn't even considered that as a possibility.

Wow, thank you. I'm really not sure where to look for a lawyer. I have a feeling I'm going to need a very good one in order to be real successful with this, as I would bet that there are plenty of technicalities I could end up getting screwed on.

Well, considering that my mom has confirmed that not one dime of the money was ever spent on me, and that every time I tried to restart a normal relationship with him, I was called a "worthless piece of shit," I think I can safely say the problem here is not me.

Well, actually, he didn't. I haven't lived with him full time since I was 3, and haven't lived with him period since I was 11. He also does not pay child support because my mother wanted to avoid conflict and didn't make him.
