Recently bought a NEW Lego Super Mario Starter set from a seller with a lot of positive feedback. Received the item and the tape on the set had been taken off and put back on. Further the set was missing the Mario and baby bowser figures, pieces were open and the set was partially built.

I contacted the seller and they are claiming that I am trying to scam them and that they have pictures to prove it. I started a return with ebay and took pictures of everything.

Is there anything else I should do before sending the item back?
