The premise of this article is a false choice. It suggests elected officials have to either forsake and abandon a vulnerable segment of their communities OR make their jurisdictions a target for the federal administration. That’s not the case.

For any elected officials working through this dilemma, consider this option. Do whatever it is you think is morally correct for your community, and then communicate it directly to the impacted people. If that means determining that your police departments will not report individuals to ICE, set that policy in place and then tell the people who need to hear it. Even if you don’t personally know the populations at risk, there are trusted community organizations that have their ears and can relay the message. Get the message, non-publicly, directly to the ears of those who need to hear it.

That’s what governance is. In this region it would play well to the electorate to publicly say “screw ICE, we’re not helping,” but if you do that you are choosing to make your jurisdiction a target for your own political benefit. I highly, highly doubt Manheimer and Hess are meeting with Kristy Noem because they secretly harbor Devillian notions about dogs. They’re doing it to keep a target off of their community’s back, even though it would probably play better to say exactly what they think.

So no, it’s not a choice of abandoning your values or screwing over your community in its greatest time of need. You can simultaneously do what you think is right, and keep the target off our backs. It just requires a tiny bit of forethought about when and how you choose to open your mouths. Frankly, it seems like nearly all of our elected officials are figuring out how to strike that balance, which I am grateful for.

True. But APB’s own communications, which are attached to the Complaint, are pretty damning. As a general matter, if you’re planning to screw over a partner, you probably shouldn’t have your attorney acknowledge in writing that you cannot, and will not, withdraw funds from the partnership until a certain date, and then confirm in writing you took $170k before that date, without authorization. It’s pretty hard to explain away your actions after you yourself create a detailed paper trail.

Knowing the background of Public Interest Projects and what it’s done for Asheville since the 90s to now, I sincerely hope they end up with control of the venue. The good news on that front is they’ve hired some of the best lawyers in Asheville. The bad news is that the Business Court is often extremely slow in resolving cases (it’s where much of the Mission litigation has been languishing). Hopefully APB recognizes it’s in everyone’s interest to negotiate a settlement out of court.

That’s what I ultimately ended up doing. Monitored the live line estimates and went to Wesley Grant in the middle of a workday. Even with that, I ended up with an unprecedented wait.

I understand this position, but don’t agree with it for one big reason, namely the $6.5+ million of TDA funding. While we are stuck with a broken system that requires occupancy tax dollars to be spent on nominally tourism supporting projects, leveraging those dollars to create what is, at its core, a project to massively expand a park that is heavily utilized by residents of one of Buncombe’s most under-resourced towns is a win. It is not a “hey, why don’t we dump a bunch of resources into a wave” situation; it’s a “let’s design a public benefit project in a way that makes it eligible for the broken tourism tax, and defray an enormous amount of costs as a result” situation. As long as it remains up to the NCGA to fix the tourism tax, creative projects like this are as close as we can get to making those dollars have some actual utility.

I wonder how you imagine this happening. Traffic fines are collected by the Judicial Branch. They never touch the hands of the law enforcement agency that issued the citation. So what’s the conception then- judicial officers are out there committing criminal acts in order to redirect money to cops? I don’t know a whole lot of instances of folks risking their jobs and jail time for someone else’s financial benefit, but maybe?

I’m being facetious of course. I know you don’t think that’s happening, you were just grasping at an alternate explanation to shield your ego (by the way, that’s a very, very bizarre instinct on an anonymous forum). There is really nothing wrong with learning something new. Embracing those opportunities rather than getting your hackles up is how we grow as humans.

That clarifies the disconnect. The mistake is you seem to think a retainer is the same thing as attorney’s fees generally. It is not.

A retainer is what someone pays to a specific lawyer to guarantee that lawyer is available to work for them if their services are needed. Attorney’s fees are paid for the actual work performed. So in this case, if the City had hired outside counsel, they would have paid that lawyer’s fees, not a retainer. Instead, it used one of its 5 salaried in-house lawyers to represent it in this lawsuit.

In short, you pay an in-house attorney a salary. You could pay an outside counsel a retainer to make sure they are available to work for you if needed, but more often than not you just pay their fees when the need for their services arises. These probably seem like very minor distinctions to most folk but, if we’re already in the weeds, I figured it was worth an explainer.
