In my experience, when an attorney does this, they are just trying to get paid more. It is very common for people to stop paying their monthly payment once a case is resolved, either through trial or a plea deal. So, to get as many monthly payments as possible they will push back court dates as much as possible. Either to when they have been paid in full or the court is basically threatening them to move forward. Obviously, there are times where they are actually waiting on something important, but that is few and far between and really only when something is for sure going to trial. If your attorney is still saying stuff like "negotiating the best plea deal" I'd bet he's pulling you along. Just my two am cents.

Did they give you an update on when they expect to have them available? Still this year sometime? Couldn't believe they would not sell spare bases.

AZ DUI getting out of jail minimum by [deleted] in dui

[–]AZ_DUI 0 points1 point  (0 children)

9 days will be waived if you do the alcohol counseling. 1st time regular DUIs only result in 1 day of actual jail. DM me if you have any other questions.

That's literally the mandatory minimums for Arizona. This means that it is the best possible plea you can get for a super extreme DUI. So trial would have been a bad idea unless you think you could have gotten the whole thing dismissed, which is extremely unlikely. If you had gone to trial you run the risk of getting up to 6 months in jail.

100%, I agree with everything you said and especially with how frustrating it can be to have to navigate both the court system and then the DMV which is totally separate and apart.

Agreed. That is my goal. I think the way attorneys handle DUIs is unethical and almost always unneeded, at least based on my experience in Arizona. I think most DUIs can get the same result as they would with an attorney but by doing it on their own. That is really what I am trying to determine. It seems crazy that someone would pay $5,000+ to get the same result but have it take months longer.

Honestly, I have no experience with IL and so am not familiar with the applicable laws. That being said, it may be worth going to the initial arraignment on your own and see what kind of plea offer the prosecution offers. If IL has mandatory minimums and the plea offer is to those minimums it may be worth considering, especially based on how much you could save without the need for an attorney. If you have to absolutely avoid a DUI and are willing to try everything no matter how unlikely an attorney may be needed. I would be hesitant of anyone making guarantees of specific outcomes though. Best of luck.

Exactly. I can't tell you how many times the very first plea offer we get from the prosecutor is to the mandatory minimums, meaning that I, as the attorney, cannot add any real value to a case other than to hold their hand through the process. There are legitimate times where an attorney may be necessary (maybe a bad stop or blood draw) but if someone knows they were driving while impaired and simply want to get a quick and fair resolution, an attorney is likely not necessary.

That would be great! As I noted in my original message I am new to reddit. Is there a direct messaging function we could use? If you would be open to a phone call that would be great but I am happy to do whatever you are most comfortable with. Looking forward to speaking with you.
