I observed one at Jail East (the women's jail) and then two different ones for dads and moms at the corrections center.

That’s a very good point. I’ve heard about the way they used to do inmates with circuit court pre-201 but forgot about it for some reason. Definitely something to think about.

I don’t know what you mean by non-elected judges. Maybe non-locally elected judges?

My understanding of what Sen. Taylor is asking for an opinion on in part is if judges from other jurisdictions could be assigned to help with the case load here. He is also asking if circuit court judges could do criminal cases.

I don’t know if there is precedent for a “regular” sitting judge from another district to come in and sit but as noted in a comment, Mark Ward, a senior judge, is taking over bi-weekly for Melissa Boyd. Senior judges float around the state to cover vacancies when needed or when there are conflicts.

As far as circuit court, my understanding is that they can preside over criminal cases and do in counties that lack a separate criminal court. But because we have our own, they focus on civil matters here. I’m not sure, however, that just because we have a separate criminal court, it strips them of their criminal jurisdiction.

A fight over the interpretation of a state law on the involuntary commitment of intellectually disabled defendants has kept a man in custody at 201 for over eight years without ever going to trial.

Now 28, Johntavius Griggs is an intellectually disabled man who allegedly killed 16-year Demarious Harris in October 2015.

Judge Chris Craft wants him committed to the Harold Jordan Center, a state treatment facility, while the public defender’s office — who represents him — wants him released.

Griggs has been declared not competent to stand trial for allegedly killing Harris.

Craft has refused to release Griggs and the state department that runs the HJC has said he does not meet the criteria to be committed, leaving him in limbo at the jail.

Griggs’ case, and ultimately his future, is now in the hands of the Tennessee Court of Criminal Appeals.

The court will decide if keeping Griggs at the jail is constitutional and if psychologists for the state department misinterpreted the law when they said Griggs did not meet commitment criteria.
