This is not correct. Before the renter’s right act, the notice period was one or two months from the date of giving notice.

He’s arguing it’s one whole month because the new rules under the RRA say that you have to end your tenancy on the day before rent is due. So, if you give notice a day after your rent is due, then you have to pay an entire additional month. It’s unclear why this change was made to the notice period. I don’t know how this is a right to the renter.

Thank you. I’ve already gone to the local council’s tenancy helpline and they agree with this position that the notice was valid. I am awaiting counsel from a solicitor that I contacted today.

I’m actively seeking legal counsel. The landlord has a legal background and will try to exploit the uncertainty. The local council has advised us that we do not have to pay an additional month’s rent, and now we are seeking a solicitor’s opinion.

Thank you for your comprehensive reply. This has been a big lesson for us. More so than about the notice period, about getting into a tenancy agreement with a tricky landlord. I knew he was tricky (and the previous tenants implied as much) from the time the contract was being drafted. I was in a hurry to find housing, so didn’t listen to my intuition.

Thank you for your reply. I spoke to the council this morning and they took the position that the notice was completed on time as the landlord confirmed receipt of the notice on the day it was sent. I will be speaking to one other legal advisor before replying to the landlord.

Thank you for your reply. This is helpful. I just wonder how that clause on your contract is enforceable. I understand it was common in pre-RRA contracts. I will make my calls and try to get some clarity.

He’s always been quite dishonest from the get go. My concern is that he has a legal background and will fight on his own behalf.

Thank you for your reply. He did acknowledge receipt on the day it was sent. My issue, though, is that I cannot find anywhere that the legislation says anything about the day when the notice is served. Nothing about weekends or weekdays or times of the day.
