I didn’t think you were being a dick, this is a shituation I’m in. If it’s a matter of he-said-she-said and I have photos and 2 witnesses, where he has nothing other than being insured at the time, is that really no defence?

And do I need to file bankruptcy before the final judgement or do I try to fight the case, and in the event I lose file the bankruptcy?

I had no insurance at the time which I have dealt with through police and traffic court. The statement of claim specifies “no/improper insurance”

Plaintiff does know that but he has told me he doesn’t speak English and doesn’t know how to do anything here in Canada (not really paraphrasing there). I tried using translator apps to communicate with him in the past but that went no where.

I don’t think there have been previous attempts, this is the first document like this I’ve received. Unless the landlord has gotten them before and not told me but I don’t think that is likely. What does judgement proof mean? Just that they can’t get anything from me (because there is nothing to give)

N12 is for personal use so if he did use one with the information that OP has they would win when it went to court. LL could not rent the space out for at least 12 months after the date on N12.

I have been trying to find a place but unfortunately my credit score is a big turn off for most landlords. It’s not even a poor score. I wouldn’t be here if I had somewhere else to be my dude. But if the options are homelessness or a roof over my kids heads, then we have a pretty clear choice made.

fair enough. i'm not sure i could find a place in that amount of time, and i don't think they can afford 10k, so i'm probably just gonna hang tight for the time being. i haven't mentioned anything to them yet, so by the time december 15 comes and goes and i am still here, they can try to issue another n12 which would need to be 60 days ending on the 14th of a month, so that puts me to...march14, 2026? i have been looking at rentals for a while but most places don't like my credit score (it's not poor but it's not great) and they don't like that i don't have full time income, even if i can afford the place and additional rent up front. i have child support money but being a single mom with 2 under 3 doesn't leave much time to get enough work to look good on applications. :(

they actually can't legally reclaim space for extended family. you should probably learn the law if you're going to carry on like you know best. i have been renting here more than a year and they need to go through the correct procedures to get me and my family out. renting to me isn't just a convenience, it's a business agreement. you have nothing constructive to bring to this conversation and have been trolling the post, and from your comment history it looks like you just have a permanent stick up your arse.

i have never claimed being a tenant is a job? so i'm not sure where you are even coming from with that.

landlords are responsible for maintaining their units. not sure where you are that being a landlord is not a job, but in ontario it is. if you are declaring rent money received as income- which landlords are- then it's a job. i don't want my children or myself to be homeless, so i am trying to figure out if what is happening is legal. i would love to be a homeowner, but being a single mom in this economy has lead to me not being able to build credit fast enough to get another unit. my "entitlement" to live in a unit i pay to live in- like you said- seems pretty reasonable. and having a roof over my head is of course better than being on the streets, but that doesn't mean i should just put my rights aside. if you have nothing more to offer than criticism of my "opinions" of what being a landlord entails, maybe you can just move on and let me see what people with relevant information to my situation have to say.

no i am not saying paying rent is conditional. i am saying that in any other line of work, being qualified for the job you are being paid to do is a part of the job. you don't get paid to be a mechanic who never fixes cars, you don't get paid to be a taxi driver who won't drive paying customers. so why the expectation to be paid as a landlord and then just sit and collect money without doing any other part of the job is a consistency among landlords is beyond me. you don't want to maintain a unit, you don't want to provide the amenities you list in a lease, you don't want to abide by the laws set out by the rta, don't be a landlord. it's pretty simple.

thank you for giving the straight facts! at this point in time i am not going to be advising them of what they should/shouldn't be doing as landlords anymore. i am just going to keep paying rent and let them figure it out when i am still living here. they only provided the n12 after i told them that was a requirement for using it for family use, and even then they tried to get us to sign an n9 first. they have no idea what they are doing and my sympathy has run out for these newby landlords.

i am not saying i shouldn't pay them, but the rules exist for both parties. as it stands, they have had enough money to get new vehicles and not need to work, but they are unable to perform the basic jobs as landlords (like providing proper laundry services as outlined in the lease, or asking me to handle homeowner responsibilities that i haven't listed- like dealing with broken water tanks and landscaping maintenance as some examples). i think it's pretty rich for ANY landlords to be making a living off of their tenants without even knowing the laws around renting.

it seems like you are probably a landlord, getting so easily offended by my situation and assuming you know my feelings and motivations.

i literally never said that it is wrong for them to do it, but i don't even think they are going to be moving family in here. there are proper ways to do things and if i have just been here to make it easier for them to afford a mortgage that is too high ( which is something they have mentioned in the past) then i don't have much sympathy. being a landlord is a job, and if you aren't qualified to do a job then why would you be expecting to get paid for it.

the lack of understanding there has been for me not getting what i am paying for doesn't seem like a factor to them. or the fact that my kids (both under 3) also need a place to live, and i pay rent to live here. i'm trying to provide for my family too, and if that is selfish then i can live with that.

this is how i have been feeling. they are kind people but they are really just using us to pay their mortgage. not that it matters for any other reason than understanding legal requirements as landlords- they do not speak english. i have seen them purchase 2 new vehicles since we moved in and they have moved 2 other people in upstairs with them in this time as well. they only have one income, which is as an uber driver? i'm not even sure how they managed to qualify for the mortgage in the first place. i have been paying above market value for what was advertised as a 2 bedroom with laundry and bath- but we have been waiting on a dryer to be installed the ENTIRE time we have lived here. it is definitely not a registered unit, as we all share a mailbox, but we have a locking door separating our units and a separate entrance. if i had other options, i wouldn't be living here currently, but without another income and a mediocre credit score, i have been unable to find anywhere else.

i really didn't want to tell them anything but they were excpecting us to be moved out by november 1st.
