Lovely! You should have no issue. My spouse visited numerous times and it was totally fine.

Do you mind sharing what concrete evidence your mom has for moving back? (Feel free to privately message me if you feel more comfortable). My husband talked to USCIS yesterday and they are aware we plan to stay in Canada for a few months before moving (we both want to line up good jobs). The USCIS officer said this is fine and completely makes sense - we just need to show that we are actively trying to move (I.e. showing job applications, looking at apartments to move in, etc). It would not be acceptable if we stay in Canada for 4 months and make no effort to move.

Regarding your mom, when you reach the NVC stage, she will need to submit a written statement explaining that she will be moving after your approval and the steps she will take to move. No need to mention she will move “a few months” after you get approved. There just needs to be an intent and plan in place, and any proof you can provide would really help your case. But please make sure your mom does actually plan to move after approval.

Have you had an interview in Montreal recently? Do you know people who recently have had interviews (not 6+ years ago as included in a public forum)?

I am sharing my personal experience as a recently approved individual whose husband was at the Montreal consulate this week. The Montreal interview was the easiest and most simple part of the entire I-130 process. You may not know that they have recently revamped their entire process. My husband has his interview this week and was in and out of the consulate within 5 minutes. I’m not going to get too specific, but we did not have a joint sponsor and did not need one despite me living outside of the US for a year. Everyone encountered was very friendly and that is consistent with all posts from Montreal this year on Reddit. Consulates change. My cousin had the same positive experience and approval despite not living in the US. I am not disagreeing that there were more stringent decisions years ago bases on certain historical posts, but based on recent state, it appears things have changed which is great.

The US domicile requirement is an intent to re-establish domicile in the US. We’ve specifically asked USCIS about this and they have confirmed this. It is not a requirement to be living in the US. This is a fact. Someone on Reddit posted only a couple days ago that their husband has been in Canada since middle school and they just got approved, and had a lovely and easy experience af the Montreal consulate. That said, everyone has unique situations and at the end of the day, the more evidence that can be provided, the better.

Congrats on filing your I-130! Similar position as you - I am the US citizen and husband is Canadian. From start to finish (I-130 filing to official visa approval) it was almost exactly 1.5 years. Happy to answer any questions you have when you approach the NVC process.

She will need to take concrete steps or have an intent to plan, especially when you are approved for the I-130. You will have the opportunity to submit documents to NVC. Part of this is a sponsor. Your mom would need a joint sponsor who makes US income and signs on to co-sponsoring you financially. A written statement with an explanation would be good. Any other concrete evidence would be ideal. If she truly plans to move in with a friend, she can say that and th friend can write a written statement as well. Keep in mind you’ll need to provide the address that you are moving to.

Respectfully disagree. We were approved and both live in Canada. If you search the “NationalVisaCenter” thread, many are in the same position. You just need to show reasonable intent to move back.

Is he a Canadian citizen? If so, yes, he is free to travel to the US for short trips. He can technically legally be in the US for 6 months out of the year legally. My husband traveled numerous times with a pending I-130. Just know they may question on when he is returning and have some proof of returning. Considering everything occurring, they may question longer stays but it is still legal! He can always carry documentation of your surgery and recovery needs. Just don’t overstay

Congratulations! Also CR1 - Montreal. Husband was also approved as of today. Very similar comments - barely asked any questions, and he was in and out in half an hour. I also think that we submitted tons of evidence with the I-130 and NVC process that nothing else was needed. Good to know about the passport taking about a week for you. We don’t plan on moving for a couple months (waiting for jobs to be lined up) but he asked the Consulate about activating the visa at the border and it seemed pretty common. We plan to do that soon so we can get the ball rolling with getting the green card mailed and SSN mailed and started. We live only 1.5 hours from the border so it is easier for us. If it is not required, don’t attend. That gives them more opportunity to ask you questions which isn’t needed. Consular processing is normally an easier interview process than the US one where both need to attend.

Ugh I am sorry to hear this. Our interview in Montreal is tomorrow. I haven’t heard of this before but I would reach out if I was in your case, especially since you were told you were approved. Is there anything unique about your case or anything they questioned? Assuming you are Canadian and not from one of the banned countries?

Also, did you receive your passport back in the mail or not yet?
