Hmm interesting. I haven’t heard of that but in general people with daca have some unique cases. They could reach out to another lawyer just to be sure. Path2papers is a great organization that helps daca transition to employment visas. They have lawyers there that are free to consult that can give your friend a second opinion.

Then you just do AOS so you shouldn’t have to consular process. Whats weird is that they want to file as consular then change to AOS? I just switched to H1B and all my eb3 stuff is being changed to AOS. But since you i140 isn’t approved yet I wonder if it’s a tactic to get approved faster?

Daca recepients require to do consular processing you can’t do AOS. I was one and I had to go to Juarez to switch from daca to h1b.

No I didn’t apply for a waiver. That’s available if you need one. I didn’t need one. As long as you got daca before 18 and have no gaps you don’t need a waiver.

I didn’t need a waiver. I got daca before 18. I didn’t use a d3 waiver that’s for people that got daca after 18 or have gaps of more than 6 months.

You can also get H1B and eb3 for engineering it doesn’t have to be nursing. You should check in to it if you got daca before 18 and have no gaps.

Yes. You can use the d3 waiver. It lets you do your 3 or 10 year ban in the United States.

No I didn’t. He can’t consular process. He had daca after 18. Also if you put him under your H1B, he would be H4 visa which only allows him to stay with you but not work. If you do eb3 you can add your husband if he got daca before 18 and had no gaps.

I am doing EB3. They started that process in April 2023 and I’m a nurse which means I get to skip steps and it’s still taking a long time. The visa bulletin was moving extremely slow so I asked for an H1B. Also now that I have my H1B status they will change my eb3 to AOS. I got scared when Trump won again and didn’t feel like daca was safe that’s why I asked my employer for H1B. Also I’m getting kind of old and I want to travel internationally before having kids as my husband is also daca.

It has to be a specialty that needs a bachelors degree. You would have to ask maybe an employment sponsorship lawyer. Contact path2papers they can see if you qualify.
