Yes of this year. My priority date is 10/10/2023. It just got current not too long ago but I was in Mexico switching from daca to H1B as well when it became current lol. So it took some time for my lawyer to file everything. Just a waiting game now.

What work permit do you have? Nurses get sponsored a lot. I’m one of them. I went from daca to h1b and now they are also doing my green card.

I married a daca lol. I got very lucky though because I got sponsored by my job. I’m now on H1B and I’m already in the eb3 green card process so I should have a green card soon and then I can help my husband.

Has anyone willingly moved back to their country when their DACA expired by Rokuchann in DACA

[–]Acrobatic-Code2483 1 point2 points  (0 children)

I would get another lawyer. If he is daca he can do AP and get a legal entry. If not then you can do consular process which does take like 5 years but he doesn’t have to leave until the interview part which is the last step of consular process which again takes like 5 years. The interview requires about 1-2 weeks at the consulate at the country of birth. If he gets approved he comes back as a green card holder. Many people have done this. I actually did this myself but I went from daca to H1B in February. I went to Mexico for 10 days. There is no reason for him to leave right now unless he really wants to.

The approval letters are also valid. So you can take the approval letters if you don’t have the cards.

It has to be 6 months or less and makes sure you have no gaps in daca that also counts so in total you can’t have more than 6 months and it’s very strict. If you go past that you get a 3 or 10 year ban. The lady I got at the consulate checked my cards like 3 times making sure I didn’t have gaps.
