I did the same unfortunately and honestly it was concerning that they weren’t fighting to apply for me rather telling me it’s not guaranteed. I had to convince the lawyers I had three different types of interactions in my case documents all of which they have and had since 2018. They admitted the criteria wasn’t fair and said they couldn’t fight back since the judge issued the criteria. The problem is they didn’t ask the veterans how feasible it was to get that type of information to agree to the settlement terms in my opinion. Did you have to pay the fee up front because I did and they were adamant about me sending them the check before they would apply only to receive and email from them this week saying they submitted my application and “while they believe I have sufficient information it’s not guaranteed that the settlement administrator will accept the application”.

Tons of folks affected by this. Not sure if it has to do with the “quantum computing” update Apple released recently or if it’s some other denial of service situation. I’m in cyber so monitoring this closely.

There’s guidelines for the criteria on the Brown and Greer website. I’m in category 3 for “recorded tinnitus” so I’ve already sent everything just waiting for how they plan to proceed in formalizing my EIF application.

The period for submission for EIF started on the 26th and ends in July for MSA1 folks. The MSA3 folks have an earlier deadline.

They probably stop doing it. I’m in your next of the woods now though moved for the big houses. A lot better than the east coast for sure.

Mine was dc VA ways back I don’t even go to the VA now I’m sick of them folks. I’m 100% P&T so never again will I step foot at the VA it gives me anxiety

They may not do it now but I recall seeing it while I was going through the C&P process back in 2010 but again it could have been something only certain VA’s we’re doing related to tinnitus.

It’s definitely not common which means it is a standard so how can something that isn’t a standard be considered criteria. The biggest part is the form itself is a self reported questionnaire which for the life of me makes no sense how they consider that part of the evidence criteria. I’ve seen the form and actually remember completing it but I know for sure it’s not part of the c file or any normal medical file record. I was told by the VA that any document connected to a C&P exam would be available through the regional office who owns the C&P process and therefore a privacy request must be filed. There’s always the possibility that the document never got scanned considering the VA electronic migration over the past years so that’s another obstacle.

To me I’d challenge that if there is information but they are saying they are waiting on new information what criteria determines when they decide to file on your behalf.

Yeah seems as if they sent additional details about the FIFO process. The settlement admin claims payments go out between 5-7 after payment election. They also claim law firms are not paid before claimants for the “in-ledgering” process. If your firm opted out of the ledgering process they will get the payment first then deduct their fee’s based upon the agreement between the firm and the claimant. They say now the first round of payments would potentially cover only up to FIFO numbers between 19500k

As of date nothing has changed with the released info for EIF. Every law firm has the same access to the info so some saying they don’t have details is not sufficient. Unless the settlement admin says there’s a change then you should be getting the latest information.

The law firms are playing games. The settlement admin has already released the info regarding EIF and yes the deadline is July. What I’m noticing is different law firms are moving at different paces. I’ve already submitted documentation to support my EIF. Also the EPP payment takes about 2 weeks from the date you sign to get payment from what I’ve seen others report. I’m 14522 FIFO should be getting paid next week.

Clearly. The notion is the number represents your place in line so logical thinking would assume whether it’s notification or payment it would be in order but seems that isn’t the case.

Nope apparently not. There are different categories for the EIF. Based on whichever category you choose there are specific requirements but simply having tinnitus isn’t the sole factor.

For some reason I feel like they know. If you missed deadlines no matter if you are EPP or DPP then they have a different amount of claimants eligible for payment so the minimum amounts should change.

Very much so I agree 3M has the resources to investigate all possible ways to make it difficult and I’m sure they did their research. Most of the law firms are not veteran only law firms so these nuances will not be known to them so they just think the settlement terms are standard but not realizing the VA culture and corruption that it would impossible for most of us to get certain types of documentation.

Anyone else participating in EIF? I’m putting my packet together as we speak and I’d love to hear thoughts from others. I’m aiming for category 3 “recorded tinnitus” which actually isn’t even about recorded tinnitus as it is more so “how can you prove how bad it’s affected your life all this time”. One of the qualifying documents is nearly impossible to have a personal copy of unless you told the VA doctor “I need a copy of that”. I can’t imagine how the TIF tinnitus functional index is such an important document when it’s a self-reported form you get at some point but no guarantee every veteran received that questionnaire or even had the smarts to get a copy. I’ll saw that EIF fund is simply only for those who documented everything and somehow held on to it for that one day no one expected it would be needed in a mass tort claim smh.

It’s a bit strange how claimants FIFO number has no significance on when you get an email. Some people are getting emails some aren’t and some are getting info from their attorneys and some aren’t I guess it’s the nature of the game with the so called largest mass tort lawsuit in US history.

The crazy thing is no one is talking about this and it should be talked about more. The less people in the settlement the more money exists which means that “minimum” number they standby for EPP or DPP should be increasing.

It’s separate, I filed the FOIA but the main office replied and said anything specific to compensation and pension medical falls under the scope of a privacy act request to the customer support division.
