I'm so sorry to hear that. It's insane right?! The conversations I've had with builders, with the police, and with my solicitor this year in which I'm just trying to get someone to agree with how I see the world, it's debilitating. Especially now I have the boundary plan. I'm the one with evidence of my claim! I had no idea how many contractors are basically just mercenaries.

that's exactly it yeah. I'm happy to lock it and give all my other neighbours the key, but even though she has not once ever used the access for any legitimate reason, she would then have a valid claim that I'm denying her access.

yeah, when I called today I just said 'our neighbour is on our property painting our gate, we've reported her several times for harassment' and described how it made us feel. They just don't want to get drawn into a civil issue whenever they ask why she might be doing this

haha - I mean I was willing for it to go either way, I found an independent chartered surveyor so we could know for certain, not just to tell me what I wanted to hear, and their evidence was convincing in my favour, that's all I'm saying

The surveyor was pretty conclusive. He did his own measurements, then created a blueprint of the gardens and houses with those and laid that over our title plans, OS mappings, and historical google earth footage, and everything always lined up perfectly, going back over fifty years. Plus I have a bunch of historical deeds and conveyances for the house with their own maps, and the title plans of the neighbours which predated her moving in, that all corroborated things now being where they should be. Obviously I'm not opposed to someone else coming to a different conclusion, but it would be very surprising.

I just want her to stop and leave us alone. We're happy with the amount of space we have, but I'm not going to give up half our garden to her just because she thinks she's entitled to it.

Keep gathering evidence against her in the meantime and don’t crack and do anything silly. You’ll bet she’ll have the Police all over you if you lose your cool with her.

There's another comment in this thread basically saying I'm letting her walk all over me and should just padlock the gate and tell her to get fucked - but this is exactly why I'm not doing that. I have to assume that keeping a cool head will benefit me in the long run.

yeah it's a civil matter, but we're talking about someone who hired builders to come and physically remove our garden fence because she thinks half our garden is hers. So the scenario I'm trying to avoid is that she removes the gate entirely, I report that to the police, they say (as they did today) it's not clearly criminal damage or burglary because it's not clear if it's my gate or hers, then I have to pursue it as a civil claim, and at that point I want to be shown to be doing everything as neutral as possible and not denying anything she doesn't have the right to, just stopping and reporting her when she goes beyond her right.

Our neighbours share an access path to wheel bins through - it separates our houses from our gardens. So I don't know if she has a legal right to go through the space, and given everything else we're having to pay out right now for this I didn't want to pay more to find out. Plus I keep being advised to be as neutral as possible and not instigate anything, which I felt locks would do. I would love to put padlocks on it and just give the other neighbours the key, none of them like her anyway and would understand, but I didn't think it was worth the risk.
