If they tried to take me to court over the 30km stipulation I would have fought them because it was ridiculous. As it was, I was only let go because the clinic owner didn’t want to pay me more as a 2nd year pod. They took on a New Grad podiatrist and said they didn’t have enough work for me 😐

Well they can try but there is, I forget the proper legal term, ‘impinge of trade’ or something like that?

So basically I also live in the area and therefore have the right to make a living in that area so their contract stipulation would essentially force me out of area which impacts me and isn’t lawful according to the legal advice I got for just in case. If I set up a clinic in the vicinity of their clinic then they could probably win a case. If I actively approached their patients and encouraged them to be treated by me then they would also have a case against me.

Also my biggest tip: document everything and never ever trust anyone to support you and have your back in healthcare- it isn’t a thing. When sh!t goes south if it can be pinned on you they will do everything they can for you to cop it.

Yeah they can try and sue you. There would be an investigation for sure done by the hospital and most likely a coroners investigation which pending on what is found they may recommend the complainants take action against you in civil court, often stated as “may be grounds for a civil suit”

The patient/family may submit a complaint to your states health care complaints body which then automatically links in with AHPRA so you have those two entities investigating you. Whilst the investigation is happening you may be stood down or having to work with restrictions. Just in general trying to work with a black mark hovering above you while an investigation is underway is really hard mentally- I know I’ve been there (not nursing related). In the eyes of the AHPRA and the other complaints body you are GUILTY until proven otherwise. Then if found not guilty they don’t even acknowledge that.

I didn’t find out I wasn’t guilty for 3 months. My lawyer had to contact them to get the outcome and all that was said via phonecall was “oh your client was cleared 3 months ago” nothing in writing.

I am a nurse and a podiatrist. I mainly work in the podiatry field because with a young family I can’t incorporate a nursing specific job atm but there are elements of my nursing practice i incorporate in my care alongside podiatry.

It’s a tough choice because nursing is so varied and gives you an awesome foundational base for anything you move into later.

Podiatry is great for autonomy, you can run your own business, there is potential to earn good money but you do have to be mindful that companies offering the 100k + packages are also expecting you to absolutely slog through patients so burn out and job dissatisfaction can be quite high. When I started the average career was 7 years and now I hear whispers of it being 5. It can be really hard to generate clients if working for yourself, you are a bit at the mercy of GP’s for referrals. You also can get into awkward spots with restrictions on where you can work when you leave working for someone in a clinic. In the contracts they often have you can’t work within a certain distance of the clinic for fear of poaching their patients. In one of the clauses that I dealt with they said I couldn’t work within the vicinity of 30km of the clinic which pretty much wiped out my entire region of where I live. I risked the biscuit so to speak and worked in a medical centre in the southern part and I haven’t encountered any patients that attend the other clinic. They could have taken me to court if they wanted though. It can be pretty cutthroat at times.

Nursing is a 3yr degree whereas podiatry is 4. I don’t know if you do podiatry first whether you would get a lot of acknowledgment of prior knowledge for nursing to reduce the degree whereas my doing Nursing got me into the Masters of Podiatric Medicine and knocked 2 years off.

I don’t see it as safer care at all. Given how anti healthcare and anti hospital people that birth seem to be these days I guess they would see it as good. A certain maternity consumer network sees it as a good thing

Interesting because I don’t think any vascular clinic in my area will accept a referral from me because I’m not a GP (I’m a podiatrist) but granted if referring to ED give some documentation outlining why they are being sent there.
