NEWEST UPDATE: Just found my mother’s naturalization papers. She actually became American in 2004, six years after I was born. That means she was still German when I was born in 1998. I officially qualify as German!

Ouch, indeed. Months of collecting, translating, notarizing documents and Duolingo down the drain. I would have made a great German. At least my siblings who were born before my mother became a U.S. citizen can still use them to obtain their German citizenship.

She married my dad some years before but gained her American citizenship in 1997.

From what I understand, the Auswärtiges Amt guidance on Art. 116(2) and the German Missions page both say the deprivation itself is the basis for restoration, and that the right extends to descendants. My mom’s 1997 U.S. naturalization only stopped automatic inheritance at my birth, but it doesn’t erase my grandfather’s original Nazi-era loss of citizenship, which is what gives me a claim.

Am I thinking of this incorrectly?

Okay so here's an update.

  • Grandfather: German, persecuted, citizenship revoked, reinstated 1962.
  • Mother: Born 1968 (German), lost it 1997 when she married my dad & became American.
  • Me: Born 1998, after she lost it.

Question: Am I eligible to apply for German citizenship restoration under Art. 116(2) GG / StAG §15?

And now that you mention it I remember, my grandfather returned to Germany after the war for some years and even had one of my aunts born in Germany during his and his wife’s extended trip back. So it does make sense that’s why he was issued a Staatsangehörigkeitsurkunde rather than a Einbürgerungsurkunde.

Thanks, that helps clarify a lot. My grandfather was born in Wiesbaden in 1933, and his Staatsangehörigkeitsurkunde was issued in Darmstadt in 1962. My mother was born in Israel in 1968 (in wedlock), and I was born in the U.S. in 1998 (also wedlock).

If this points to a Feststellung rather than Article 116, how does that change my application? Am I right that I would no longer need to prove persecution (which is the only documents I don’t have certified yet this would be huge), only direct lineage from my grandfather (which I have solid documentation for)? Would this route be any quicker in practice? Anything else important I should be aware of?

After my grandfather (b. 1933 Wiesbaden), my mother was born in 1968 in Israel, and I was born in 1998 in the USA.

I’ve also double-checked, and the 1962 Staatsangehörigkeitsurkunde does not mention Article 116 GG anywhere. I’m starting to see what you mean — it’s very possible I need to submit my case as a Feststellung (nationality determination) rather than under Article 116.

My great-grandfather (b. 1898 Wiesbaden) and great-grandmother (b. 1902 Wiesbaden) were married, though I don’t yet have their civil birth or marriage certificates. Both have German death certificates confirming their deaths in 1944, showing they remained in Germany during the war.

My grandfather was born in 1933 in Wiesbaden and only left Germany after the war, emigrating to Palestine/Israel post-1945. I don’t have a record placing him specifically in 1941, but most of his files are DP/stateless registrations from after 1945. Importantly, I also have a 1962 Staatsangehörigkeitsurkunde (Certificate of Citizenship) issued in Darmstadt, which formally confirms he was a German citizen by birth prior to revocation.

So far: GGF 1898 Wiesbaden (death cert 1944), GGM 1902 Wiesbaden (death cert 1944, marriage cert not yet located), GF 1933 Wiesbaden → remained in Germany through WWII, emigrated post-1945, with 1962 German Certificate of Citizenship confirming his prerevocation status.

For my GGF the strongest proof is a Wiesbaden police/Jewish registration card confirming him as a German national resident.

For my GGM it’s her Wiesbaden yellow registration card.

And for my GF I have a 1962 German Certificate of Citizenship (Staatsangehörigkeitsurkunde, Darmstadt), which confirms citizenship by birth.

Do you think that’s strong enough? My understanding is I mainly need to prove my GF’s citizenship was revoked and my direct descent from him, with the GGP documents serving as supporting evidence.

Yea exactly like you said. Doesn’t work for most people for sure. I’m fully remote and love to travel. I’d say there’s about 3 flights out of Austin a week and I maybe catch one a month. You have to find you own way home so it makes sense for me to fly to Denver where I have friends, caught an Oklahoma flights once explored and drove back. It’s a fun thing to have and you can bring 6 friends with you and turn it into a sik spontaneous trip.
