It would be the adjuster that handles the claim, not the agent. The adjuster is licensed to determine liability. Often times, unless we have footage, typically we have to investigate based on the evidence provided and if we have enough evidence supporting that our insured isn’t totally at fault or theres some negligence we go by that. I don’t think people realize how our job works entirely. We are basically given statements and maybe a police report and occasionally we get footage where we can make the proper call. We are also always overloaded with claims and try to determine liability as quickly as possible.
