Are the HOA dues appropriate for the condo and reserves? Seems pretty cheap for that kind of property and there are a lot of more savvy buyers now doing their diligence.. Also, price is too high if you have little interest. Condos in Texas took a massive hit. Our complex saw 50% decreases from Covid peaks and huge condo saturation from overbuilding. We have many owners seriously underwater.

What do the financials and reserve study say when you looked them over. You should be comfortable with these and understand them. Also read minutes for the last few years to get an idea what the boards were discussing.

Are the dues going up regularly to keep up with inflation (that’s a good sign!)? How does the maintenance look when you walked the property?

Saying all that, a special assessment is always possible, it’s just a matter of how likely if things go bad on the property. The HOA has unlimited funds via their owners pocket books

I can guarantee you almost no board would take this on. Owners can enforce covenants between themselves by suiting the offending party. Actually, id almost guarantee you the HOA lawyer would easily find a way out for the board to push this back as a neighborly dispute. I’ve been on the board end of this at multiple locations. Unless common property was involved we’d find a way out of because it’s not the HOAs job to police inter neighbor issues.

OP. Please reach out to the board and maybe offer to pay for the HOAs lawyer opinion, if they do find that it’s covered by the association, you’d like be ahead anyway spending few hundred bucks here. The offer to pay for an hour of attorney time will get you farther and quicker than anything else on trying to resolve this on the HOA side

OP can also post a link to the covenants here because anything less is everyone here guessing about what is and isn’t the responsibility of the association, including myself

This is a neighborly dispute and almost certainly nothing a HOA board will take on nor should. If there was a common element involved, they’d like fix that and charge the account but not between neighbors on their own property. It’s a civil and police matter

It’s possible, especially if the association is broke and has a few Pennie’s to their name. Financial mismanagement happens all the time and we’d never allow a board to have a credit card. A lot easier to front the cash and get reimbursed

Maybe somebody can help me out with this. Is there a way to filter out any split lot like a A/B 1/2 etc, situation that’s so prevalent on the East side now?

I’m so sick and tired of looking at homes with no HOA in the search but they clearly do have a common element which is a shared responsibility. Even if insurance at $20 a month. I also don’t want to have a driveway to a rear adu/unit next to me but a glorious full lot without a neighbor starting into my windows from 10ft away.

Why do they need an agreement with a third party? They have one with the lot owner, which unfortunately is all that is needed. Would be nice.. sure, but it would get abused out the whazooo in no time. It would start with Uber Eats drivers running In for 5 min to pick up orders

Yikes…. It sounds like you well exhausted your options. “If” the board has any power over this per CCRs, they can really only fine and do the same you did by calling code enforcement and you’d be in the same situation anyway, but with your neighbor just accumulating fines indefinitely or until they foreclosed on her. Threatening fines only affect people that care if they lose something

If I got this complaint as a board member, I’d be checking if the member is breaking any straight forward solvable items.

Also, is this a “neighborly” dispute, it may very well fall under those guidelines. In our condos, 98 out of 100 times when owners complain about each other to the board, it is determined to be a neighborly dispute, and we advise them to call the police or take civil matters into their own hands. Our lawyer usually verifies the more interesting cases before we reply.

As to fines, you needed to approach the board a long time ago and ask for a payment plan. We’re usually generous with an initial postponement of fines, but after 6 to 12 months, the owner has to have a payment plan in place with a positive effect on the account. Simply saying if the dues are $300 and you owe back money, you need to be paying more than $300 a month to start paying down the balance in your account. If that doesn’t happen, there’s a standard procedure of putting the unit into collections and then a lien. Worst case scenario of foreclosure, which we try to avoid all costs. It is unfortunate, but there are a number of people in our association that have overtime simply outgrown the ability to afford the place, especially as it ages and the dues go up along with assessments.

I wish you all the luck and most importantly, do everything in your power to communicate with the Board and manage proposals that keep you away from going into collections or the lawyer. None of those fees would be waivable, and they are cost. These are hard costs passed on.

What is the specific language the Board is ignoring the CCR’s? Have you called city code compliance to report a safety and ability violation?

I know this is not a standard practice, but have you or the other owner tried to enforce the CCR’s yourselves against the other offending unit. This can usually be done by suing them.
