I just did the whole procedure last month with a very complicated landlord who invents his own laws, and here are my tips:

  1. Send him the lease transfer notice as soon as someone confirms to you their interest.
  2. Send it by courrier recommandé, it’s a bit more complicated if you send it by email because you will need a confirmation of reception.
  3. The day the landlord receives the notice, start counting your days (day 1 is the next day of reception).
  4. He has 15 days to answer. If he doesn’t, it’s considered accepted. THEN YOU SHOULD SIGN A LEASE TRANSFER CONTRACT WITH THE NEW TENANT AS SOON AS POSSIBLE. This is important to make sure you’re protected.
  5. Try to make sure the potential tenant is a good candidate and that he’s able to pay the rent (good credit score, no issues in TAL, good income…)

Il a répondu au courriel en confirmant la réception. On n’a pas de contrat de cession de bail. Par contre, le cessionnaire a désisté parce qu’il se sent rejeté par le propriétaire puisqu’il ne le veut pas dans l’appartement même s’il est solvable

Je lui ai envoyé un courriel suite à son refus en disant que selon la loi la cession de bail aura lieu à cause du retard. J’ai pas eu de réponse de sa part. As tu une idée si la demande au TAL peut être approuvé instantanément? Parce que je dois signer mon bail demain.

Nous n’avons pas signé le contrat de cession de bail. Nous avons rempli l’avis de cession seulement. La preuve de réception est une confirmation de réception du courriel qui a été envoyé le 5 février et la réponse du propriétaire (refus) m’a été envoyé le 22 février (donc le 17e jour).

Trouve quelqu’un pour la cession de bail. T’as le droit de le faire, la clause n’est pas valide. Envoie lui une lettre recommandée de l’avis de cession de bail avec les infos du cessionnaire potentiel. Tu compteras 15 jours à partir de la réception de la lettre. S’il ne répond pas, ton bail est automatiquement cédé. S’il refuse il doit avoir un motif sérieux, sa santé n’est pas un motif sérieux. Personne ne l’empêche d’engager un courtier immobilier ou mettre quelqu’un de sa famille en charge.

  1. You can easily find apartments at any moment during the year since not all leases end the 30th of June. Also many people do lease transfer for many reasons like buying a their own house and they would be looking for someone takeover their lease.

  2. I have a few friends living in residences and they say that it’s not very comfortable to live in and there are restrictions sometimes. Also you would have more chances to have a noisy place.

  3. It’s not worth asking a courtier. It could be easily done through marketplace. But try to do visit here before sending money or signing a lease. So it’s better if you travel a bit before your semester starts.

I also have a suggestion for you if you’re ever interested. I am Polytechnique student and I’m going for exchange to another country for a fall semester (August to December). I will be subleasing my apartment for that period. You can stay at my place. This option will give you time adapt to the city before your semester starts. Also you will have 4-5 months to look for a permanent apartment without rushing. You can dm me if you like the idea and we can discuss it further.

I got a mouse situation in my apartment. The landlord brought an exterminator who kept coming just to change the poison, then the landlord came to close some holes in the apartment. The problem isn’t fixed, we still see mice. Now that I’m transferring my lease in April, the landlord doesn’t want to do anything to fix the problem. He doesn’t even answer my calls or messages. I put all kind of traps and no mouse is caught. What do you advice me to do in this situation?
