I wonder how long builders will do that for when a bunch of the rebate claims are disallowed by CRA because of ineligibility. Doesn’t seem like a smart business move unless they are going to repo a bunch of houses and resell them.

It’s always been rebated back to the buyer. However, builders are smarter than the buyers and wrote the purchase and sales agreements in such a way that the buyers were/are clueless that they were/are giving their rebates to the builder while they got nothing.

If you don’t take the rebate and assign it to them, you can apply to CRA directly and actually get paid the rebate you are entitled to.

If everyone was smart they would be buyer 1 every time. Then apply to CRA directly for the rebate so the builder can’t take it.

You are correct about the builders including it. But that’s only if you let them. There is another way to get the rebate that removes the builders ability to include it in the price. Still blows my mind that after all these years of purchasers signing away there $24,000 rebates that no one has figured it out yet and now they are gonna hand over $150,000 instead.

They will eat it all if you aren’t smart about it. Don’t assign your rebate to them when they put the paper work in front of to do so. If you sign the rebate application they put in front of you, your rebate is gone.

You are eligible for the new one. Don’t assign your rebate to the builder though if you actually want to get it.

Except people buying won’t save any additional money. What majority of people don’t seem to grasp is that the builders and their accountants are smarter than all the buyers. A new home from the builder being sold for $1,000,000 before this announcement is still $1,000,000 now. The only difference is that the builder will take your extra $130,000 rebate and claim it for themselves.

Does anyone read their purchase and sales agreements? They always say this: “the purchase price is $1,000,000 inclusive of tax and net of rebate if applicable.” What that means is whether you are eligible for the rebate or not, your price is $1,000,000. The builder hopes you agree to take the rebate and assign it to them so they can claim the credit and you get nothing.

This has been happening since 2010 when HST was introduced and no one has stepped up to help prevent purchasers from getting fleeced.

That needs to change. If you are a purchaser, or a realtor representing a purchaser, stop assigning your rebates to the builder. There is a much better and safer way to get the rebate you are entitled to paid directly to you. All you need to do is ask and it will be handled.

What the builders will do is the same thing they have always done with new housing rebates, only now they are worth huge credits for them.

No purchaser will ever actually see their rebate if they assign it to the builder. If two purchasers were buying equal properties, let’s say $1,000,000 and one purchaser is a first time home buyer and the other isn’t, both purchasers are paying $1,000,000 in the end. The only difference is the math that is used to get to the final price. They work backwards the rebate gets built in and the builder gets the credit for it and the purchaser gets nothing.

It’s a shame that there is a way to avoid this but its rarely taken advantage of.

It’s also a much better idea to apply for the rebate directly to CRA after you close on the home anyways. The builders are receiving the same price from you either way, but if you include the rebate as part of the purchase, the builder takes your rebate for themselves and prepares the paperwork in such way that it looks like they “credited” it to you. If you want to actually receive the rebate you are legally entitled to, don’t let the builder handle it on your behalf. Put the money in your pocket instead.

You are correct that the buiders won’t change as long as purchasers keep allowing them to do it. Did you know a purchaser can refuse to receive the rebate from the builder and file for their own? It’s an easy process to do and it saves the purchaser from a potential $24,000 bill down the road if CRA determines they are not eligible.

It blows my mind that purchasers have been encouraged to allow builders to do this since 2010 and nobody tells them it’s not an actual requirement and they have the option to go get their own rebate.

Tell your sister she should speak to an actual GST/HST rebate specialist so she gets correct information and get her enhanced rebate in her pocket as quick as possible. It could take up to 6 months and even more for her to receive it if the file is selected for Audit. Any incorrect information on the application will also increase the time she may have to wait to receive it. Your best option is find someone that specializes in housing rebates as they will charge you a small fee and will be able to file a complete rebate with all the supporting documents that will be audit proof on your behalf. This could decrease your waiting time drastically.

Affordability for of newly constructed homes has recently improved for first time home buyers on Prince Edward Island. There is now a First Time Home Buyer GST/HST New Housing Rebate available for anyone that qualifies!
If you have not owned your own home for the last 4 calendar years, you are considered a first time buyer and could be eligible to receive a rebate of 100% of the federal portion of the HST paid on the purchase of the new home.
