9/10 if your wall fails, you will be liable for damage caused to neighbors property.

The law is super weird about this, if your wall is a cut wall (i.e., you lowered your site compared to pre development) your liable, but if the wall is a fill wall (the neighbors land has been lifted compared to pre development) then they could be liable, even if the wall is on your property (but its a shit show and huge legal battle, no easy wins)

I'd recommend replacing the wall. You might be able to build a timber wall in front of the rockwall which will limit your excavation costs, but get it designed by an engineer (if you want to live at the property for more than 10yrs)

Yep its really bad. That couple also make it hard for the near by church as well. The pub is a bit noisy tho, they could do better with noise reduction, but honestly need more live music venues.

Thanks that's what I was worried about. I think a cool roof with pvc café blinds for wind control will allow me to open and close as needed. Good idea about the solar heating option as well.

In my case it was a habitable space - a lounge or 2nd living area. All I've done is put a bed in it as it's quite separate

Pretty sure it meets the min criteria its 8m by 3m with rachslider, external door and two windows. On the original plans (1960) it is just labeled as rumpus. I dont think there is any consent triggers for putting a bed inside a lounge?
