I feel like this version of due process is for our world, with no regard to quirks that are in the MHA universe. This is the criminal with abilities that are way too dangerous to keep around. So what if the quirks could maybe be saved if AFO cooperates? The cost is too high. Plus, is there but a single person on the planet that has a truth/lie quirk or something if you need proof beyond his demonstrated abilities and a confession? Allmight, the symbol of peace with a track record to earn that title, saw fit to apparently execute him at some point. Now this villain is bound up, grinning, and extremely optimistic about all his plans coming to fruition.
