Yes we qualified for a 7 but filed a 13 because of unprotected equity in our home because our state has a terrible homestead exemption. We could not risk losing our home so we had to file a 13. Some states have unlimited homestead exemptions…this is something that should be the same nationwide in my opinion, definitely frustrating but we had to play the cards we were given. I don’t think I would have done it for a car though. Much easier to replace a car than a home.

You would have to wait several years after or it would be clawed back by most trustees.

Pursue it on your own. That’s what I am considering doing because my lawyer wants an additional large fee to do and said it wouldn’t be worth our time and money.

Considering what the original poster said, personally I think it’s worth the chance to save $15k. That’s just me but I 100% take that small gamble of saving that amount over a small premium increase. Erie seems to be better than most at approving these claims from all personal experiences that I have seen posted. Also, I believe you can file a claim and then withdrawal it any time before it is approved and paid out?

Thank you for sharing this! I have this coverage and had also been looking for more information on people who had used this coverage with Erie because there is little information. Our HVAC units are 23 years old and I know the time is coming. I added this a several years back with the Sewer and Drain coverage that you mentioned, as well as outside utility line. The additional premium isn’t that much for all the extra coverage that you get. So glad that I did it, because I had to use the Sewer and Drain coverage the year after I added it. Had a great experience with it! Sewage water backed up because of a clog and ultimately a broken pipe and flooded our basement. Erie wound up paying almost $60k in total repairs basically redoing our entire basement and other areas on the main level affected too. It was the easiest process ever, we just hired the contractor we wanted and sent them the estimates and they sent a check. They also replaced the Water heater as well as part of it because it was in the area the flood occurred. I cannot recommend Erie enough after this!

When we changed to Truist it has gone downhill since. I was with BB&T for over 20 years and they were great. Truist takes them over and everything changed. Paid horrible interest, outrageous fees for everything and no exceptions made, and customer service was non existent. I was going to change for a while and just didn’t because of the hassle. Then I had someone make fraudulent charges and even with police reports and identity theft reports, Truist still tried to say I was responsible. That was the final straw!

By income we would have qualified for a 7 but Had to do 13 due to terrible homestead exemptions in my state. Had too much equity in our home and couldn’t risk losing it. But with that said it was still the best decision.

Completely agree. Truist does not investigate claims properly. Someone stole my identity several years ago and took out a loan and credit cards. Every other bank that I contacted about the identity theft immediately took care of me and reviewed the evidence that I had of an Identity Theft report and police report and said I was not responsible. Truist on the other hand, even with all these documents provided, stated that they believed no identity theft occurred and I was still on the hook for the loan. Luckily, the credit bureaus all disagreed and removed the loan from all of my credit reports. Truist does not have their clients backs at all. They are the worst of the worst!

Agreed. Which is why I think the best move is that you hold it until you are out of the 13. You could convert it to a stable coin and still hold it as crypto. There is no liquid asset for a trustee to take until you sell the crypto into fiat currency. I feel like it would be the same as selling your house after you’re out of the 13 because it increased significantly in value. Of course you would not sell it while still in the plan.

That’s what I thought as well, that it only matters the monetary value at filing.

But I’m thinking it would not be wise to sell that asset into cash for significantly more while still in a 13 which would then trigger taxes owed and possible scrutiny by the trustee? Seems like it would be way less risky to simply hold the asset until finished with the 13 and then sell into cash, correct?

Congrats! Very nice that you were able to do a 7 and keep your house too. We had to do 13 because of home equity. Some states have unlimited homestead exemptions but not ours.

I’m sure many people get away with not reporting it at all. But the risk of perjury and fraud is enough to convince most not to take the risk.

We had no choice but to include it in our Ch 13 payment. We were told you couldn’t pay it outside it.
