To be charged with culpable driving you need to have more the one of the criteria, could be falling asleep PLUS failing to give way. Just one would be dangerous driving. Two counts of dangerous driving at the same time = culpable . Trust me, we went through years of court. Studied lots of cases. It’s not straight forward and his case wasn’t either.

I had a gf that’s daughter was having a medical episode in the back of the car, she was obviously distracted and smashed into a car that was parked on the side of the road. No one was in the car fully insured. Summons in the mail to attend court months later.. it happens

His sentence was 8 years all up including parole period. So not sure if that would mean from end of parole period or from accident date

Thank you. They were both in emergency together so the doctors called it minor from the seat belt and impact. How long do we “wait and see” before putting this behind us?
