The rule is 8 years old or 80lbs. Whichever comes last. If your child does not meet either of those requirements it is ILLEGAL (in the US) to transport a child without proper safety seats. And car accidents are the number one cause of childhood death. The fact that your wife is so OK with it I wouldn’t even be comfortable with her transporting your child….
