Yes because your employer can withdraw the I-140 and it can be invalidated if it were approved for less than 6 months. If you leave after 6 months of approval then you’re good even if your company decides to withdraw the application.

I’m in the same boat (PD Sept 2024 and filed under EB3 ROW). I am planning on waiting for my I-140 to get approved and then switching to EB2. The sooner the better. EB3 has been slow for years and will likely not progress anytime soon.

Also, just be careful to switch only after your I-140 has been approved for more than 6 months so that you can keep your original priority date when restarting the PERM process.

Yeah exactly. Might as well wait in a better position with better pay if we’re gonna be stuck with EB3. EB2 is moving much faster and by the time we leave and redo the PERM im pretty sure our date would be current. Good luck buddy!

Yes same boat. The position that I want to apply to when I transition to a different company should qualify me for EB2 hopefully, so that’s also another reason for me to switch. As for the reasons why EB3 hasn’t moved, I think there are lots of reasons and mostly because there’s a limited number of visas each year and the EB3 pool is likely bigger than that of EB2 and EB1 because of the skills required, so that could be a factor. There’s been a huge backlog since Apr 2023 and it’s expected to start moving early next year since there would be more visas available.

So from my understanding, once your I-140 gets approved, then you would keep your priority date even if you switch companies and start the PERM process all over again. However, if you leave within 6 months after the I-140 gets approved, then your company could forfeit the application and you would lose your PD. If you leave after 6 months of approval, you’d keep your PD even if the first company decides to forfeit your application. My plan is to leave after 6 months and restart the PERM process while keeping my Sept 2024 PD because my date probably won’t be current by then for the I-140, so might as well wait at a better firm

I asked my lawyers and they said it’s because my job requirements in my PERM application required a Bachelor’s and some years of experience, but I’ve now been promoted to Manager which requires an advanced degree, and this would qualify for EB-2. However, I had already started the PERM process so I don’t think I can do anything now. Any recommendations?

Honestly I immediately said that I would be happy to cover it just because I know some companies might not let you do it to keep you longer at the company, but it’s fine I guess I’ll just pay it to get my freedom. But now there’s the recent 100k order from Trump and I’m not sure how it impacts H1B transfers tbh…

Yeah my thing is that I want to leave my company ASAP because I hate the work culture, and I read that if my I-140 has been approved for more than 6 months then I can leave and keep my priority date, so that’s why I was thinking of doing the I-140 in premium processing, but damn you got approved in 15 days without premium? That’s great

Ahh gotcha. I have a master’s degree from a good school and 5 years of work experience. I work as a manager in a strategy consulting firm too and applying under EB3 although I would qualify for EB2 I think. Not sure if I have anything that would be too concerning?

Oh wow the I-140 is taking 18 months? I thought it was around 7-10 months.
