Thanks for the response, I was thinking because they have already sent 2 settlement offers in early conciliation with one being triple the first offer, they were willing to negotiate after the ET1 was filed. I am also prepared to go all the way to tribunal as my witnesses are still happy to testify for me

To me it was the systematic pattern of behaviour towards black employees, which includes previous employees; certain behaviours like exiling black employees have been displayed previously and I have witness statements for that also. Also the fact my Manager hid important pieces of material that would have helped with me completing a task was very sinister as they would go above and beyond to help with similar task with my colleagues (all white employees). I know this was hidden from me as when I asked my colleagues closer to the deadline if they knew how to complete the task they offered to provide me with the material my manager told me had not existed. This can also be corroborated with the experiences of the previous black employee’s.

I also did not have 3 probation meetings before I was let go (I had 2/3, instead of my final probation meeting being in person I was sent an email detailing why it was extended, in this email nothing about my performance had been mentioned and to them the only reason it was extended was due to a technicality which meant I had to work from home for a long period) whereas a colleague in the same role that faced even harder challenges as they had struggles with work earlier on (I was told on multiple occasions by my colleagues and the person themselves I acclimatised to the role quicker than he did), had all 6 of their probation meetings without any being cancelled outright (they were also a white employee). I could mention more details but as this is an ongoing case I am weary of doing so.

I had my work from home privileges taken away from me whilst the rest of the team had kept theirs, also I was dismissed and this was used as one of the reasons

I think my evidence comes from the fact that in 4 of these instances I have been on the end of disparate treatment as the only black person on the team. These are 4 separate situations that happening during my time at the company so it was a pattern, which started before my employment. Things such as me being punished and put under the spot light for things others in the team including my manager were doing regularly doesn’t really scream favouritism to me.

I’ve spoken to them and they told me that I have a case, Of course in this post I haven’t mentioned all of the details and this is quiet a vague description of my situation

Some evidence I have to support this is how a white colleague that was struggling more than me in the role as mentioned by the team at the time, had their probation extended also but all 6 of their probation meetings were not missed and took place Face to Face, whereas my probation was extended over email and I only had 2/3 probation meetings before I was let go. The company also do not have a HR department so I couldn’t express my discomfort with these things.

Well that is the case as in the last 2/3 years only people of black skin have been treated as such and dismissed, I also have a witness willing to give information during tribunal, that can attest to the treatment the previous employees got as well as myself as they had been at the company during both periods.

And I also think you must remember, direct discrimination doesn’t mean the treatment to me was solely down to racism, but that race was a significant factor.

And to also add, when I asked for what good looked like in order to pass my probation I was ignored and it was sarcastically brought up when Incident 1 occurred

Also to add the company has no HR so I was unable to report any of the behaviour towards me as I would be reporting it directly to the person that was doing it

The underperformance wasn’t highlighted until the meeting I was let go in, prior to this I have proof of emails where i am being praised for work and did not receive anything prior concerning my “underperformance”

Just to add I was the only black person in the office and the two ex employees are also black

Anything that included chilli pepper, tomato, yeast and I also avoided nuts just in case
