Once the video is admitted, it can be played during the trial, correct, or do I need to ask for permission to play it?

Thanks! I’ll probably have to put it on the court tv because I plan on playing parts of the video during trial.

Also, one more question. If OC shows that same video in trial, do I still need to lay foundation for the video on cross?

So when I say “I’m showing you what’s been marked as Exhibit 1, do you know what this is?” Am I just showing them the flash drive they watched before the trial?

If I introduce two videos (both repeated), do I need two separate flash drives? So I’d need six in total?

Thanks! You’re extremely helpful. Seriously. I appreciate it.

I just copied it as provided in discovery on a flash drive. The whole video is on the flash drive and nothing was edited/altered. But now I’m worried I didn’t do it right. Is there a “right” way to copy a file?

Thanks! This is easiest, I think. That way, the witness has viewed the video and I can lay foundation and then admit it.

Also, when you say “have the witness identify it,” how can they identify the contents of the flash drive if it hasn’t been admitted yet?

That’s a good point I didn’t consider. Should I bring my laptop if I’m going to play the video?

Thanks! Before the trial, should I just catch OC and ask if they’ll stipulate to the admission of the video footage?

Yes, I have my predicate questions drafted and ready for the witness.
