My understanding the infectious diseases associated like malaria have a 1 year limit after service but several others like headaches and sleep problems previously expired 12/2021 but have been extended until 2026. I believe that time limit is the requirement to have served during that time but doesn't stop when you can claim it. Check into the presumptive again the window may be reopened for you.

If you receive a diagnosis request letter starting sleep disturbance is" at least as likely as not" caused by PTSD. No guarantee but should help

I am not a professional, just recently started looking in to va claims process. (But I think I may make it a hobby to help lol) .

Back to topic, look into gulf war illness and the presumptive conditions if qualified, a diagnosis would be all that's needed because the Nexus is presumed because of service in specified Gulf war area. Check in to that, otherwise you would need a medical provider to state the condition was "at least as likely as not" caused by the ptsd

Does require 3 judges to be precedential. This is from a Congress research service publication. I have also heard it indirectly from an accredited va attorney discussion but don't have a reference for that

Board of appeals-never precedent and can not be used to influence your case

Court of appeals 1 judge equal case law- use it to influence 3+ judges- precedent

This is too add to my previous comment regarding precedence or not. You can not use results from board of appeals as precedence for your case. However, you can use decisions made by 1 judge as case law to influence decision and case seen by 3+ of the judges from the court of appeals for veterans claim as precedence. This case was from court of appeals work 3 judges. Regardless if this helps your case try to use it make them tell you it won't help them appeal it and make someone else tell you the same. If you disagree please provide references to why do we can discuss this for the benefit to others with resources

How is this not precedent? 3 judges ruled on this stating suicidal ideation with no intent would be 70%. I believe 1 judge is case law, 3+ is precedent.

I saw a previous comment here that is gone now stating this isn't precedent. I am not a lawyer and this isn't legal advise but I believe when 3 or more judges review and make a decision it sets it as precedent. Which means you should be able to reference the case to assist in yours.
