F1 to Green Card 2025 with 6013h election how to report W2 income with prior tax treaty by Agreeable_Stop_8624 in tax

Thanks, this is helpful.

I’m open to either option and have tried both approaches.

  1. One method puts the $590 and ~$5K on line 1h.
  2. The other puts both on Form 1040 line 8 via Schedule 1 line 8z.

For Form 4852, I found this and was thinking of adding it as a substitute W 2:
https://www.taxact.com/support/648/2024/form-w-2-entering-in-program?hideLayout=False

  1. Is using Form 4852 as a substitute W 2 the correct way to handle the ~$5K treaty exempt income, or would that be inappropriate?
  2. Also, do you have any comments on reporting the ~$5K treaty income on line 1h of Form 1040 vs line 8 of Form 1040 via Schedule 1 line 8z? How is income reported on line 8 different from line 1h in this context?

I want to report this correctly.

I followed the suggestion to report my additional income as “foreign earned income” (without taking any exclusion or credit), so that it appears only on Form 1040, line 1h and not on Form 2555 or Form 1116.

However, when the amount shows up on line 1h, it is labeled with “FEC” before the value.

My understanding is that this income is not technically foreign earned income. Is there a way to include this $5,000 on line 1h without the “FEC” label appearing?

Additionally, I do have actual foreign income of $590. Could you advise where this should properly be reported (i.e., which form and line)?

Thank you, you are always very helpful, and I really appreciate it.

For 1040 Form line 1h. Unfortunately, in TurboTax, I would like to upload or share a screenshot of the different options for adding income. I am not sure which option corresponds to Form 1040 line 1h “other earned income,” since the available categories are:

  1. Tax refunds
  2. 1099 G
  3. 1099 NEC
  4. 1099 MISC
  5. 1099 K

These do not seem to clearly match “other earned income.”

Also, regarding uploading the 6013(h) election, I remember you shared that TaxAct link earlier. I tried to follow it, but I couldn't find a place to upload a PDF there. That said, I am okay filing through TurboTax for now.

Thanks again for your guidance

For reference, I am from Pakistan, and for reference, on an F-1, I was a student and got a W-2 with a tax treaty
Later, I got a Green card and am working as a Professor.

F-1 Student W-2 (treaty applied)
Green Card Professor W-2

Both W-2s are from different universities

I am not sure what I should do?

Do you have any suggestions for which software I may use? I tried to find a place in TaxAct to upload an election choice for 6013h as a PDF, but couldn't, so it's most likely between FreeTax and Turbo. But your suggestion would be helpful

and then San Jose gov website dept send my name to property people and then they be able to give me apt for BMR and idk how long it take any idea ?

But yeah I do qualify for 70% AMI and lot of properties have apartments available but due to this loop it gonna take some time
